The Deportation of Kilmar Armando Abrego Garcia

I gather you're educated but I think you're unfamiliar with a few basic legal tenants here in the United States.

The first is habeas corpus. This is a fundamental legal right and court order that protects individuals from unlawful imprisonment, requiring the government to present a prisoner and justify the detention before a judge. This right of Garcia was violated by DHS. If you don't like that Garcia is afforded the writ of habeas corpus, then you similarly have no objections to you, personally, being arrested and imprisoned in the future without any cause, right to a hearing or legal process.

The second is due process. This is a course of formal proceedings (as judicial proceedings) carried out regularly, fairly, and in accordance with established rules and principles. Garcia's right to due process was violated in multiple ways including his deportation to El Salvador despite a court order prohibiting this, illegal detention, vindictive prosecution, and now coercion.

The third is the fifth amendment. The Fifth Amendment guarantees due process for all persons in the U.S., including undocumented immigrants. Your suggestion that Garcia has no rights to due process, therefore, is simply wrong.

Look, I understand that you *think* that guys like Garcia are guilty until proven innocent and should be instantaneously deported, but that's not how the legal system works. Trump and his goons have played loose and fast with the law to fulfill his campaign promises, but the judicial branch is catching up with him and holding that many of his actions have violated the law. Not only with Garcia, but also with all the folks Trump illegally deported to El Salvador and Venezuela.

Again, you may not like it, but persons residing here in the US have basic legal rights... and for good reason.

None of that has anything to do with the case at this point. He was brought back to the U.S. and is facing charges in Tennessee, as far as his deportation that can be carried out via the deportation order from 2019. He has had basic rights, the only question has been where to send him at most.

Jawtator has no idea what he is rambling about, let alone law.

Not sure what you are rambling about, it would appear he is being deported via the original deportation order. His criminal charges are pending as well.

According to the case file, which I have reviewed, his deportation order is from 2019. He has already been found in violation of law over a half decade ago. He wasn't instantly deported, his deportation order is from 2019. That is the problem, he has been here way too long. There might be more too this, but I don't know what it would be and you haven't shed any light on it.

He has already been found to be in violation of U.S. law and nobody is disputing that he is an illegal alien. He has a valid deportation order.

Whether he committed additional crimes at this point doesn't seem too material to his ejection.

They don't have to justify anything, they have a deportation order from 2019. All his pending charges are just the icing on the cake to see who is mentality ill to defend the fence jumper and wife beater. Whether or not she chose to press charges doesn't really mean anything at this point. Its way time for him to go. What exactly do you think you are doing?

Unless someone can show something of value, it would seem like he should be deported fairly quickly. The only question whether it was done under the Trump order or the INS order is the destination of his ejection.

As far as I am concerned, just drop him off in Uganda and than do some missile testing there. This is a terrible waste of time, money and resources on the woman beater.

No, anyone can have an opinion. Now whether he is legally criminally liable for a crime, yes the assumption he is innocent until proven. But all of that is immaterial at this stage. Apparently, you got what you wanted and now appear mad at the outcome. It's very possible the other way was better for him.

It would seem like he beats up women or his wife has issues as well.

Regardless he is an illegal and should have been deported years ago.

I guess people can dispute certain things under the Trump order, but nobody appears to be disputing the original deportation order. The only issue in this whole thing legally is where he could be sent or can't be sent. He should have been deported over a half decade ago and if he were additional crimes could have possibly been avoided.

Drop him off via the original order and be done with this nonsense. If he doesn't like it wherever he is sent, send him a freaking Hellfire missile at this point.

Interesting compared to these documents she filed..that's a bit more then being cautious after an argument...

According to the petition filed by Jennifer Vasquez on August 3, 2020, in the District Court of Maryland for Prince George’s County, Garcia verbally abused her, kicked her, slapped her, shoved her, mentally abused her kids, locking them in their bedroom while they cried, and detained Vasquez against her will.
In November 2019, Vasquez alleges that Garcia grabbed her by the hair while in a vehicle. In December 2019, she states Garcia grabbed her from her hair in the car and dragged her out of the vehicle--abandoning her in the street. In January 2020, Vasquez claims Garcia broke her son’s tablet and broke doors in their house. In March 2020, she alleges that Garcia pushed her against the wall while breaking phones and TVs.

This newly released petition was filed in 2020, prior to the petition Vasquez filed against Garcia 2021. In that filing, Vasquez claimed he bruised, punched, and scratched her while ripping off her

He had his due process in 2019 before Trump ever even knew about this case. He had a valid deportation order and still does. The El Salvador thing is just window dressing.

You keep overlooking the fact that Garcia had his case looked at and the deportation order was agreed to and signed off by TWO judges, then withheld by a higher court.

He IS guilty and will be deported by court order legally.
