It really isn't that hard. The parents who committed a crime have no right to get off scott free just because they birthed a child here. If there aren't consequences for law breaking illegals, then should there be consequences for native born citizens if they have families? "Your Honor, I know that I have been caught cheating on my taxes for years for hundreds of thousands of dollars, but please don't send me to prison, you will be separating me from my family!!"

The child would likely have to be either an adult (18 yoa) or legally emancipated from their parents. Legal emancipation is a state decision, not federal. Some states have emancipated as young as 14 but those are extremely rare and specific circumstances like a child star with bad parents but who is able to financially support themselves.

They have no legal choice to stay if that is how due process (INS process) works out for them, they have the choice to bring their kid as a generalization.

Why would that have anything to do with the Constitution? Upon conviction a defendant is giving up some Rights codified in the Constitution or the more like some of the founding documents i.e. Liberty. It happens every day.

If we're talking criminal illegal parents with U.S. children than they are still their children, and as a generalization they can go with the parents. I don't see why we would generally be involved in that, but there are situations which the taxpayer would have to shoulder the burden for the criminals.
