Josh Heupel submits court statement supporting TN Attorney General's NCAA lawsuit

The lawsuit said the NCAA rules prevent an athlete from earning their full value.

Heupel's complete declaration to the court is attached to the article. It includes a strong response to the issue of irreparable harm, which the judge ruled that he did not find in the first hearing.

The declaration is on behalf of the state of Tennessee's argument that the NCAA's NIL recruiting ban violates federal antitrust laws. As most people here know, UT is not a plaintiff in this lawsuit.

Danny White, Jackson Lampley, Spyre Sports Group co-founder James Clawson, and economist Andrew Schwarz have also submitted formal declarations in support of the state's lawsuit.

Have you seen Purdue games? He runs a ton of PnR to be fair. Runs the floor well too for a big man. Nobody that big is going to match a SF's athleticism, but he's not a total stick either.

I'd completely agree DK is a more dynamic (and exciting) scorer and could still end up outscoring Eady (Eady is #3 currently, Knecht is #26 but rising). But all-around player, that's questionable.

Pts - 23.1 (+2.9)
Rebounds - 11.7 (+7)
Assists - 1.7 (-.3)
Steals - .2 (-.5)
Blocks - 2.3 (+1.6)

Knecht:
Pts - 20.2
Rebounds - 4.7

Please recall that this hearing on the temporary injunction does not mean that the case itself is decided. The case will have to be heard and judged on its merits unless there is some settlement beforehand. But this injunction is extremely important because it would compel the NCAA to refrain from further action against UT until the case is later decided.

It is worth noticing too that very many if not most news articles pertaining to this case omit the fact that the NCAA changed its rule after the fact in order to prepare and proceed with this action against Tennessee. This is a disreputable practice -- and in itself suggests that the NCAA did not believe that UT had violated NCAA as they existed at the time of signing Nico.

They will never collectively bargain their NIL value away. That is essentially what they earn for commercials. No league bargains that aspect of player income. The only real benefit to the payroll part is schools could offer the same base pay for lower level athletes. For conferences where all the parties can afford it. That could be collectively bargained, but top athletes will want more. Always. A cap at the team level can exist to help also, but again people will want to exceed it the same way franchises pay the penatly to exceed it in pro sports. The toothpaste will always be out of the tube on top athletes, like Nico. Schools will find ways to sweeten the pot beyond what Joe blow on the practice squad gets per the CBA.
