Not terrible news. Denial was always a risk with this timeline, for the very reason the TRO was denied. The case has merit, that was acknowledged and it will proceed.

This is not UT's suit. Preliminary discussions with the NCAA have not gone well and took an adversarial turn. UT has already investigated internally, and the university self-imposing any more than it already has is unlikely. Aggression will be met with aggression. That's clear. So the NCAA is at a fork in the road.

Any insight into why that is? Speculation by several on here and other sites centers around the NCAA thinking we got off without much punishment regarding Pruitt and was pissed. Is that pretty much the sentiment from the powers that be?
 
The whole key is winning next week. Don’t win, and the NCAA has the power and will likely target Nico. They ultimately wouldn’t win in the end, but they would get their pound of flesh from UT while the case is litigated over the next 1-2 years. Obviously UT would fight back but we really need to win next week.
 
Live long enough, you'll have plenty of regrets. Mine is not joining the ROTC. But, cool story bro.
Also missed out on seeing The Stones in Nov 89 and Pink Floyd in May 94 at GaTech for equally stupid reasons...of course those are way farther up the regret ladder than missing STP.
 
For anyone else that’s looking to put the legalize in layman’s terms:

Irreparable harm - refers to harm or injury that cannot be adequately compensated or remedied by any monetary award or damages that may be awarded later.

So, the judge is saying (I think at least) that the harm isn’t irreparable because if the harm is monetary related than the harm can be remedied at a later date.

So the argument will need to pivot a little bit to show how NIL restrictions are irreparable in other ways or that monetary harm can be irreparable if X, Y, Z happen.. I think..idk.. that’s for the legal experts to figure out.
Does it have to do with the time frame? There is no concern for irreparable harm between today and the 13th, so there is no need for a TRO?

I guess. There are about 4 FM stations in knoxville that are popular. . . pop. . . ular, 😂 107.7, 98.7 (I think), used to like 102.1 when it was the oldies, 104.5 (99.9% garbage), 103.5. . . probably a couple more. Most likely all top40.

They aren’t, but they also play crap mostly anyway.

Red Barn Radio up in Kentucky though plays great music that’s newer than 2006.

Nope...and I wouldn't take Smart over him either unless I was assured he would always have his normal 3-1 talent advantage.

Always remember this when assessing bowlcut boy...freakin Botch Jones beat that hack when he only had equal talent.

I respectfully disagree. If we don’t get the injunction, and then the NCAA aggressively goes after Nico, and UT, while the case is pending,we would renew our request for the injunction, and in my opinion, have it granted because it would be irreparable harm to punish the athlete as far as eligibility and the institution while the case is pending. That’s not just about money.
 
I thought I read a post by @LA Vol that said we hadn't. I think the reason we know what they're going after is because of the info we've provided. I don't know why we've even cooperated at that level. I hope from now on when they want something I'd refer them to a lawyer that says something along the lines that he need a court order to provided whatever they need. I would offer them nothing even if it is exculpatory.

Every morning Monday thru Friday I listen to 103.5.

I think if this leads to athletes being paid employees through a collective bargaining agreement, I could see this hurting women's sports and non-revenue men's sports. With title IX does that mean women and men would have to be paid the same? If so I could see dropping a bunch of sports. I mean sports like track amd field could easily go by the way side. Swimming as well. There are advantages to keeping the compensation outside of the University's purview (NIL).
