I think it's important to examine all the options here. I think if Tennessee, Virginia, and all the other states in the south (the ones that care about football) band together, they could really do something about this business of a federal ruling potentially going against them.
Because the last time they all banded together against the federal government, it totally worked out…

In the lawyering world, is this a hint for the NCAA to settle?
It certainly could be taken that way.
But it’s not a hint. It’s a judge evaluating where the case is, and applying the current status of the law to the facts presented. And the NCAA from his view right now is the NCAA is gonna lose the case.

Unless you think Kirby's QB gets the UGA NIL no matter where he plays next year.

NIL for roster retension just is pay-for-play. There is no difference in principle between that and a new recruit. The latter is just an angle that was cooked up to go after Nico.

We'll hope for the best on the 13th.
 
For anyone else that’s looking to put the legalize in layman’s terms:

Irreparable harm - refers to harm or injury that cannot be adequately compensated or remedied by any monetary award or damages that may be awarded later.

So, the judge is saying (I think at least) that the harm isn’t irreparable because if the harm is monetary related than the harm can be remedied at a later date.

So the argument will need to pivot a little bit to show how NIL restrictions are irreparable in other ways or that monetary harm can be irreparable if X, Y, Z happen.. I think..idk.. that’s for the legal experts to figure out.

Thought I'd read in a couple of place that they'd received the notice, and that's what we responded to. (Also why we know what to respond to.)

If we'd gotten no notice, we wouldn't know that it's about Nico/plane/Spyre/Booster claims/etc...
I thought I read a post by @LA Vol that said we hadn't. I think the reason we know what they're going after is because of the info we've provided. I don't know why we've even cooperated at that level. I hope from now on when they want something I'd refer them to a lawyer that says something along the lines that he need a court order to provided whatever they need. I would offer them nothing even if it is exculpatory.

The court found the states have a likelihood of success on the merits of the antitrust claim (meaning the NCAA #NIL rules likely violate antitrust law), but found there is no irreparable harm. Which is why the TRO was not issued. The TRO not being issued isn’t damaging to the merits of the rest of the case based on what I’ve seen.

Just means damages/ harm players may incur from now to the 13th isn’t of such a special and irreparable nature to issue a TRO.

The injunction also requires irreparable harm to be proven to be granted too. So we will just have to argue our case to prove how they are irreparable at the injunction meeting. We’ve got a week to figure it out, if they haven’t already.
 
I didn't name her after Raquel Welch, but I did always love the name...we just picked it because I always thought it was pretty and unique and my ex agreed.

We agreed to each pick one UF her two names and she wanted to name her after her mother, so I picked Raquel.

That's why I was laughing at myself and said "I don't know why I said all that" at the end of that post. I should have nuked everything after the first sentence. 😂 My bad. I knew that stuff about Welch because I had looked her up a couple of months ago when someone posted a photo of her.

Agreed.

I think the spirit of NIL in the NCAA eyes was to pay current players who have produced on the field. I don't really disagree with that logic but the way they went about implementing NIL was dead ass backwards and frankly quite stupid.
 
Any cap will be violated under the table by the NCAA pets. It will reverse the documented parity that has taken place. Meanwhile their rivals will be attacked. The bag game loses it's advantage when confronted with NIL. The bag game protected class would be back in business worse than ever skirting a team cap with impunity.

There is no crisis because Saban got beat out for Nico and then Bama (who has taken portal players from other teams all along) now lost some players to the portal when their coach retired?

What is the "crisis"? I don't see it. But "crisis" and "wild west" are repeated so often that the repetition appears to be affecting viewers just like advertising does.

The only crisis I see is the continuation of the corrupt NCAA's intentionally crooked and unjust double standards in enforcement.

NIL and the portal largely take that power away from the abusive NCAA. That's a feature not a bug.
And where in the hell do you see us landing in the chaos ladder of greed? Let me explain something that you and nearly everybody else don't seem to get...we ARE NOT at the top of that food chain...what you all want will doom us to perpetual second best....unless you know a few more super rich billionaire Tennessee fans willing to buy players through NIL...because our little pathetic 4,000 Spyre contributors ain't gonna cut it.

I want an even playing field...period.
