City of Waverly is suing CSX for the flood that killed 20 people and destroyed most of the town.

CSX failed to clear debris behind the culvert/bridge for YEARS and it backed up. That backup inevitably caused the build up of floodwaters and consequential tidal wave. Should be interesting to see what happens given how powerful CSX is.

IDK how CSX operates so it might be different but Norfolk Southern would probably just pay for things and move on. That's probably CSX's best move too. They have a lot of freedom but because of that they would get hit really hard in a case like this where's there's years and years of fault. TBH, it's inexcusable. You can ask anyone who ever had anything to do with RR work.

Man...I hope I have the same level of comfort as some of you that have recently lost your fathers. We found out last Saturday dad has pancreatic cancer, right now just focusing on getting time with him as much as I can and trying to help with whatever him and mom ask of me. He's only 59 and has been in good health until here recently.

As they should try. I’ve help a few cases like this in litigation when the city was sued for failure to maintain culverts and their engineer’s retort was a 100-year (or whatever) flood generates as much *new waterborne debris and is impossible to know what debris was the *proximate cause. They could fight and easily win against the city IMO. The burden of proof is on Waverly. It’s really sad, that railway created a levee and inundated the town. *I have no idea if they are at fault. Just my experience with flooding and lawsuits*
