If the civilian area has been evacuated, possibly. However, plenty of video of citizens berating Ukrainian military for taking up positions near residential areas, schools, hospitals, etc so the civilian areas had obviously not been evacuated. You're trying to justify a war crime.

Hell, the Ukrainians won't allow the civilians to evacuate because they are blocking the humanitarian corridors.

Any building with reinforced concrete and a smaller profile would be the best option. Residences, new commercial buildings, sky scrapers would not be good choices (at least, in America).
