If the civilian area has been evacuated, possibly. However, plenty of video of citizens berating Ukrainian military for taking up positions near residential areas, schools, hospitals, etc so the civilian areas had obviously not been evacuated. You're trying to justify a war crime.

Women and children were not evacuated from the cities during the battle of Brittain. WTF did you learn your history?
