Gun control debate (merged)

The 2nd Amendment is just the best.

Seriously this is the story you go after? A lesbian woman robbed at gun point, by at least three but probably four men, has two dogs stolen, is shot at as the robbers leave, defends herself and gf with no reports of collateral damage.

How is this anything but a win for the 2A.

Where was your precious government to stop the robbery and assault before the shooting started? When seconds matter, cops are always minutes away.

She wasn’t defending her home when she opened fire. She was an idiot and hopefully she’s charged, convicted and sentenced.
Article said they were shooting up the home as they left, and she returned fire. I didnt watch the video, does it show something else?

She didn’t start shooting until they had ran from her property, she was firing indiscriminately down the street. She was lucky she didn’t hit an innocent bystander.

She does exit the house and shoot blindly down the street but if I run out chasing after someone who has my dogs and bullets start flying I’m likely doing something similar

You would duck behind a car and take indiscriminate unaimed shots?

EL, as per usual, can't get out of her own way on this topic. (In her defense it's a terrible time to be a Bidenite so she's probably even more unstable than usual)

This one has two chapters. First being armed looks pretty good when balanced against an armed invasion. That in fact is a great 2A support example. It gets a bit sideways when the application gets outdoors and shooting at fleeing people. There's possible negligent discharge violations in that as well as overt civil liability risks.

pj does raise an interesting point if it could be sold as a kidnapping. I think that often expands the leaway.

Is Florida a state that considers pets part of the family? I know some states treat them differently with how you can defend them.

I only went with "could" in my post since I honestly don't know the answer to that question. In any case as pj alluded the kidnapping "mindset" could certainly be introduced by an attorney in an attempt to sway a judge/jury even if not specifically protected by hard law.

I know kidnapping was specifically brought up in my ccw class which is why I mentioned it. I'm not sure what it would take to apply it to pets but might be worth a look

In a general sense I think pets are considered property*. As such (again with the "generally") I wonder about any hard laws specifically bringing, for instance, a dog into the same realm as justified use of force on behalf of a (human) third party. I really do think there would probably be more than a little sympathy shown in most instances for somebody getting violent towards Lassie.

*I believe there's a level up on "service animals". To what extent that would play into justification of lethal force I'm not sure and would probably vary from place to place.

Interesting. Nothing of the sort mentioned in mine.

What was defined with regards to kidnapping?

Probably just going through situations. I just remember it being a justified use to thwart a kidnapping. He said you'd better be damn sure though and I told the class that wrestling my toddler into the car could sometimes be confused with kidnapping
