No one is put in prison JUST for simple marijuana possession

If someone in TN is busted for an OZ of weed for personal use, is this a felony? Or if someone is growing plants for personal use and no intent to sell, it is still punishable correct? Meaning you are incarcerated.
 
Do you think making it legal will allow people to grow it themselves? They will either buy it from the industry at high prices or will buy it cheaper from the gangs and criminals they do now or grow it themselves and STILL risk going to jail.

Making producing your own illegal is plain stupidity. The only reason a legal product would be more expensive than a legal product is taxes and fees which again is pure stupidity.
 
I understand what you are saying completely. The point I am trying to make is incarceration over possession of pot is a waste of time and space inside of prisons. I am not a weed user any longer but having gone down that road, it is much safer than many legal drugs that people partake of every day. If someone is crazy enough to shoot up or smoke crystal meth, then they have chosen to be a dumbazz.
Im not arguing for or against weed legalization. It's just funny when actual physicians and nurses who KNOW it's negative affects on the health (especially mental health) of people are ignored by potheads who want to bring up "CBD oil cures cancer" and other BS>

It's not some miracle drug, it's simply a "healthier" version of cigarettes for those with addictive tendencies to latch on to

Yes long hauling does require drug testing by many carriers.

I’m just speaking of what I know . Insurance will play a really big part on the business end but DOT isn’t going to allow us to smoke and drive . I’m all for it being legal for everyone , but if I’m honest I’m not really excited about a SWIFT driver hauling 60k pounds at 75 mph down the interstate high . That’s probably hypocritical of me somehow but I’m just being honest .

Second, if you have a medical prescription does that mean your use would be protected by HIPPA laws?

I've had guys that worked for me that I knew were pill abusers show up for work barely able to stand. I've had them drug tested and they passed. If they have a prescription then their positive test is removed from the results due to HIPPA.
HIPAA has nothing to do with that...and i dont know where you work but it sounds like your HR has some serious issues...I work at a Level 1 Trauma center, and even with a prescription if they showed up to work high, they would be fired and maybe arrested.

You said "no one" but I will agree rules have been relaxed for small amounts of weed.
well i am sure there is probably a guy rotting away in federal prison for bootlegging too, but we are discussing the modern era.

AND NO ONE is arrested and put in prison JUST for simple possession of weed.

Most pot connoisseurs would absolutely prefer to grow it themselves or buy it from a legit dispensary that know something about high grade marijuana. There is no telling what people are putting inside their bodies when they smoke commercial bricks smuggled across the border.

I would think drug abuse would be punishable regardless of having a prescription or not. If you’re taking a drug that prevents you from doing a job safely then you need to be on medical leave. If it’s a chronic condition shoot for disability but you’d probably be outed as a drug addict before you got that far. If someone has a prescription to smoke weed I’m still gonna bet there’s no guarantee they are free of consequences.
 
Ok...TN has a law on the books where you cannot fire someone for being a smoker but it has never been tested in court to see if it protects hiring.

Tn is not one of the 29 states that has hiring protection.

It’s time we stop locking people up from buying, selling, and using what is in all reality is just a naturally occurring plant.

You have to prove they're high hence the drug test. If they have a valid prescription the positive test is omitted due to HIPPA. I own my own company and called both a health care provider that performed the test and a lawyer. HIPPA prevents the employer from know what prescription drugs the employee is lawfully using. Check it out. I know what I'm talking about.

@Rickyvol77 You were or are in law enforcement correct? If pot were decriminalized, would this decline commercial pot from crossing our borders illegally from Mexico?

It's the gray area where the employee is somewhat functional. Just claiming to be tired. To fire someone for being intoxicated you have to have some proof. I've been through this more than once. I know what I'm talking about.
