Getting arrested is not the cops proving anything..... you are suspected of drunk driver..... you would still have to go to court and proven guilty.

If an intoxicated person is in the vehicle at any time with access to keys it’s aDUI





Driving under the influence of alcohol or drugs is illegal in every state. But what if you get caught drunk behind the wheel of a parked car? It surprises many drivers (especially those who pull over to "sleep it off") to learn that the DUI laws of most states also prohibit drivers from "operating" or being in "actual physical control" of a car while under the influence. In other words, you can get a DUI without actually driving.

That is the way it should be, sure. The reality is when talking about traffic law in particular, if you can’t prove innocence or you didn’t do it, the assumption is the officer is always right.
 
No. People fall asleep at the wheel then they are sober, too. At least dude was in the drive thru getting something to eat so he would sober up. I think a lot of us - including myself - have driven drunk in a Wendy's drive thru lane late at night.
Another dumbass excuse for criminal behavior...There is no excuse to drive drunk or high...EVER

Word is those cops were fired at mayor's request, fast forward to the recent shooting, Mayor wanted them fired too, police chief said wait a minute. Mayor wouldn't budge, chief resigned in protest. Mayor condems officers and labeled them as murderers. Mayor will get sued city will pay, mayor will be thrown out on arse.

Yeah. Which is why I have said we have put the cops in an impossible situation. Walking away is the best option they have.

They are even less safe at work than usual, are facing pretty universal condemnation, everything is under a microscope, any perceived wrong doing is treated as a real one before the facts can be established.

The irony of what the cops are going thru is noted, but it doesnt help the end situation.

Remind me of your libertarianism when someone you love is killed by someone convicted of DUI. Your murder logic is nonsensical. Being intoxicated in a vehicle is motive enough or should they wait until there is a car full of innocent victims?

I have and I still disagree with out DUI laws.

Many people in NYC are pointing out the hypocrisy of state & local leadership in continuing a draconian lock down while barely flinching at scores of protesters not wearing masks. Do as I say ..... not as I do logic ....

He’s not necessarily wrong. I was trying to think of any other law where you could arrest before the fact and I can’t. In Tennessee the key has to be in the ignition however you can’t sit across from a bar and wait that is entrapment.

I'm fine with the key part, but I think just sitting in a car with no keys in the ignition does not constitute DUI
 
55-10-401. Driving under the influence of intoxicant, drug or drug producing stimulant prohibited Alcohol concentration in blood or breath.

(a) It is unlawful for any person to drive or to be in physical control of any automobile or other motor driven vehicle on any of the public roads and highways of the state, or on any streets or alleys, or while on the premises of any shopping center, trailer park or any apartment house complex, or any other premises that is generally frequented by the public at large, while:

(1) Under the influence of any intoxicant, marijuana, narcotic drug, or drug producing stimulating effects on the central nervous system; or

(2) The alcohol concentration in the person's blood or breath is eight-hundredths of one percent (.08 %) or more.

(b) For the purpose of this section, drug producing stimulating effects on the central nervous system includes the salts of barbituric acid, also known as malonyl urea, or any compound, derivatives, or mixtures thereof that may be used for producing hypnotic or somnifacient effects, and includes amphetamine, desoxyephedrine or compounds or mixtures thereof, including all derivatives of phenolethylamine or any of the salts thereof, except preparations intended for use in the nose and unfit for internal use.


Also in Tennessee you can be charged with DUI by Consent (although i never had to arrest someone for that)
 
I have another question I've been given conflicting info on. Can you have an open container as a passenger in Tennessee?
