You dont think it should be criminal to be influenced to the point of passing out in the middle of operating heavy machinery in the vicinity of civilians?

I'll say it again, public intoxication at worst.

There shouldn't be a law on the books covering drunk driving, only drunk crashing with stiff penalties. If someone is pulled over for driving recklessly, intoxicated or not it should be a reckless driving charge.

Sleeping and passed out intoxicated from alcohol or OD from drugs are not the same thing. And police liability wise have to take someone that is such to the hospital for medical care they can’t “take them home” 🙄
You posted that ANY TIME someone is in a vehicle with access to keys, and they have a BAC, it's DUI. That's a ******** law. If they had been driving, prove it. Otherwise, you are promoting laws written to make it an automatic conviction because they can't actually prove the part they want to make illegal DRIVING while intoxicated.

You're describing the Minority Report thought crime part that people took issue with. I'll tell you what "good" shouldn't come from it. A DUI charge.

No. People fall asleep at the wheel then they are sober, too. At least dude was in the drive thru getting something to eat so he would sober up. I think a lot of us - including myself - have driven drunk in a Wendy's drive thru lane late at night.

But if you try to walk they arrest you too. Granted a PI is easy to beat, especially when the judge laughs at the cop in court

Lol. Says the “guy” who thinks the drunk driver stopping by the drive thru is doing the responsible thing because you assume they’re trying to “sober up”. Lol. What about the drunk driver just trying to make it home without stopping??

I thought the guy was killed for being drunk in the drive through?

Yep and I’m ok with changing that law but currently if I pass out drunk in the drive thru at Wendy’s then I know I will be going to jail.

He was a great guy. He only had 19 beers and a couple puffs off a blunts. Then he was was just trying to sober up and get some food on his belly while knocking back that last beer so he’d be the worlds greatest dad at his little girl’s birthday party.

Even if they change the law, you'd go to jail since Wendy's has closed circuit video of you driving up and passing out. It would be an easy investigation for the police to prove that you actually drove while intoxicated. But the point is...They should be responsible for proving the crime to get the conviction, not lobbying for ******** laws, written in a such ways that convictions are guaranteed because they can't/won't prove the crime.

This shouldn't be too complicated for people to grasp. Even the dimmest lightbulb should flicker when the connections are made on this one.

Getting arrested is not the cops proving anything..... you are suspected of drunk driver..... you would still have to go to court and proven guilty.
