Florida's 'stand your ground' law under scrutiny after father killed over parking spot

Blame to go around everywhere.

1. Too many handicapped spots for a bunch of lazy, overweight sloths
2. Hoodrat displaying typical ghetto head bobbing, gum smacking, attitude over clearly parking in handicapped space
3. Old entitled baby boomer geezer with a gun trying to throw his weight around and Barney Fife a situation
4. Hoodwolf/white knight boyfriend coming out to defend hoodrat's honor and just escalates a verbal confrontation into an assault

This entire country is a dumpster fire. Where is our soul?

This whole situation is tragic and pathetic at the same time. Much like your first comment about overweight people.

I don't believe that the illegal parking caused the shooting. I think it had more to do with the assault. If it was the illegal parking, he would have shot the woman.

The parking situation set everything in motion. If this piece of trash would have minded his own damn business like a normal person, he wouldn't have blood on his hands.

Is your immediate reaction to a fight to murder someone? The victim should not have thrown dude on the ground, but I think putting a bullet in his chest is an extreme overreaction.

Also, if someone was threatening/harassing your SO, would you not intervene in some way? Especially with your kids around? Or stand there and let this POS intimidate and eventually attack your SO and kids?

I hope the guy gets arrested and tried for murder. He won't though. And he'll kill somebody else eventually.

Ah the good old days, when dueling was legal and you could murder someone in the street. Or take the family to a lynching. And beat your wife with the appropriate sized rod.

Religion has nothing to do with it. A busybody that should have minded his own damn business murdered a guy in broad daylight. He'll do it again if all it takes is parking illegally to set him off.

Best to avoid all public confrontation in our political climate; stands a good chance you'll get shot by some POS with a gun.

Shouldn't have knocked him down. Not saying that justified being shot or not, but he had no right to hit the man. None.

My guess is that he saw an old white man and he thought he could easily whoop his ass.

If you come away from this only pointing the finger at one individual, then you are clueless.

The shooter has a history it seems:

Another Circle A customer, Rick Kelly, told NBC affiliate WFLA that he encountered Drejka in a similar situation a couple of months ago. Kelly said he had pulled into that same handicap spot and Drejka began inspecting his decals to see if he had the right to be there. The situation escalated.

"He was basically threatening to shoot me that day," Kelly said.

And in 2012, Tyler Smith, 18, accused a driver later identified as Drejka of hanging a gun outside of his truck window during a road rage incident in Palm Harbor, northwest of Tampa, according to law enforcement documents obtained by NBC News.

And with that history, they still allowed him to have a carry permit?

Edit: Not that we should be taking permits away willy-nilly, but the point is I'm illustrating that usually, permits are usually taken for similar incidents.

Old guy was looking for a fight. Young guy obliged by pushing old guy to the ground. Old guy had a right to pull his firearm to stop the threat. There seemed to be plenty of distance between the the two where the old guy could have waited to see if the young guy was going to continue to assault him. To me the old guy crossed the line.

Government granted him a special place. He feels entitled to confront someone who isn't supposed to be there.
Shooters' history has red flags all over it.

Been watching the coverage of this, and something not discussed is the burden of proof on a SYG defense.

The law was changed last year, with the backing of the NRA but over objections of prosecutors and many in law enforcement. Now, if a defendant claims it, the burden is on the state to show by clear and convincing evidence that the defendant is not entitled to the defense.

The concern of the opponents was exactly what happened here. Even if this was wrong, the state would have had an almost impossible time overcoming the defense. As long as its debatable, it's tough for a charge to even be made in the first place.

Here, though the shooter is arguing with the girlfriend, the first physical act of aggression is by the boyfriend shoving the guy. Given that it is at least debatable, the facts do not clearly and convincingly show the defense does not apply.

I agree with you. I mentioned that the victim shouldn't have thrown dude on the ground. I just think it is an insane overreaction to murder a guy over a fight.

Goes to show how quickly a situation can spiral out of control. People really need to get back in the habit of minding their own damn business.

Wouldn't have happened to me. I wouldn't have opened my mouth to someone parking in a handicap space. I have seen it many times, and kept my mouth shut. I also wouldn't blindside somebody right off the bat. 2 dumbasses with short fuses, and one of them is dead. Too bad.

It’s crazy we can get so numb to watching a man die... and then dialogue about JT afterwards... go hug your wife/husband and kids if you have them... no one wins in this.

Anyone who flashes their concealed weapon on a regular basis to intimidate folks in public doesn't need to be carrying.
