Sigh...read this slowly...if they weren't drunk in the first place, said damage to person or property would have never happened, hence the reason for the law.

Driving drunk has been illegal for quite some time, last time I checked people still drive drunk. Hurray for the law!

I've lost a loved one to a habitual drunk driver, the laws as written and enforced DO NOT ****ING WORK!
Only drunk crashing should result in DUI and the penalties should be harsh, extremely harsh. They should absolutely include automatic jail time, years not a weekend. However DUI checkpoints and .08 BALs do little to nothing to stop actual drunk drivers, they just line the pockets of the state, legal profession and insurance companies.
As a LEO of course you should get a drunk driver off the road should you pull one over for swerving or driving erratically but it should be treated the same if the driver was sober meaning a reckless driving ticket!
I am sincerely sorry for your loss. A good friend buried her son at 19, after being paralyzed from the chest down since he was 4 because his dad got behind the wheel after he was drinking.
Driving drunk or impaired is, at best, a contributing factor, at worst, the direct cause of vehicle deaths where a driver was driving while impaired.

I disagree...People are idiots that drive drunk with all the options available to get home safely. Getting distracted is not the same as making a conscience decision to put others life at risk by your actions.
If the aim was to actually prevent people from driving drunk the cops would sit in the parking lot at the local bar offering breathalyzers and calling cabs. But instead they choose to set up a checkpoint a mile down the road.
Making drunk or impaired driving legal is stupid. Period.
Defining the arrest of an impaired driver, before they've actually managed to kill someone, as a pre-crime is stupid. Period.
