For you people in the legal field, what is the timeline of this? Where would it be tried? Who determines when there will be a trial? How long are the plaintiffs able to amend the suit they've filed? Etc., etc., etc...
 
I'm saying you're blowing it way put of proportion. Just like TS said, fights on a football occur. It's the nature of the beast. Someone always has to throw the first punch. Does the reason for the fight make it rise to assault in your opinion or should we have all these altercations result in criminal prosecution?

By the letter of the law yes who throws the first punch is guilty

I have said lockerroom issues should be handled internally but in extreme cases that practice can be very risky. This is one of those cases IMO
 
At this point the only thing I'm worried about is whether Butch's job could possibly be in jeopardy due to current allegations or future allegations, and that's looking more and more unlikely. Anything else is a non-issue for me as a football fan. NSD is 11.5 months away and the season is 6.5 months away. This story will old news by then whether they settle or it goes to trial. Going to trial will keep it in the news to some extent, but no one will care much by then

So you're saying the subject of the fight is what raises this to assault?
 
Why would they settle now? It's exactly unfolding the way they want. They're playing the media, and people like you like a cheap ukulele.

Settle now to make it go away

I feel very very strongly that if this goes to trial heads are going to role for portions of this that aren't really all that harmful actions by the university.

We have endured enough bad PR and settling starts the fading away

I have no idea what was done or if anything was done. If anything, it would have been something behind close doors. Nothing should be done, IMO. It wasn't an unwarranted assault in which multiple people attacked an unknowing victim. This was simply a fight. Between two college football players.

I know other posters have already mentioned this, but this happens ALL THE TIME. It's commonplace. Players fought in the locker room, in the training room, in the weight room, on the practice field, etc. ALL THE TIME. These things happen. I've personally seen it happen during my college football days. We are talking about a team of college-aged, testosterone-filled males who are playing a game that revolves around smashing into/hitting eachother. Fights are going to happen. Normally they are broken up and it's over. Ocassionally a player would have to run extra gassers after practice. That's it. All these people spouting off that Maggitt should be criminally charged or should have been kicked off the team have no clue. That's not how it works.

By your own admission it wasn't handled in house. It was investigated by the police and the police didn't think it rose to the level of assault.

They don't have the sheep where they want they have our entire athletic department where they want it.

This is a nightmare right now.

I don't think we settle now either. Should have done that on the front end IMO and this PR vulture attacks wouldn't have been nearly as rough

I took the police reports to be done much later in the investigation of the rape charges

Hopefully it did happen right after the alleged assault.

This is not only a Tennessee thing, though. This is a college thing period. We're paying attention now because it's about our football program, but this has been happening elsewhere and at some point is going to reach critical mass. Universities are not equipped to handle cases that by all rights should be prosecuted criminally, but the feds' relentless insistence that they do has led to a flurry of accusations, counteraccusations, lawsuits, and the like. Some have merit. Some don't.

This is coming down the pike for lots of other schools, mark my words. It already has at Columbia, and UVA, and Montana, and on and on.

Time to settle is time to settle. They do not want to go to court. Thats why there is so much crap listed in the filings. If they turn down settlement, they open a lot of doors that have a high probability of being detrimental for the plaintiffs. The figure won't get higher no matter the future accusations that are leaked or added. The longer this drags, the more time the defendants conduct their own inquiries.

Mr. Stephens, has Peyton Manning got in touch with UT to talk about what is going on and is he going to join UT's efforts against this case since he too is a part of the lawsuit?
