Do we know anything about the lawyers pushing this for the plaintiffs?

I may be way off, but my assumption is there are some local/state lawyers involved, but that they are also tied in with a larger, more national firm that will keep popping up in lawsuits against other schools.

UT won't be the last of these by any means. I would imagine other schools are simply getting ready.

I looked up David Randolph Smith, and he is a local Nashville attorney. Has many years of experience and appears he has been successful. He went to Harvard undergrad, Texas law school, and taught at Vandy for a few years in the 80's.

(Maybe a dumb question, law is not my strong suit.)
 
I am much more worried about the ramifications of cbj not handling an assault on one of his players than I am what he called that plAyer

That's the biggest issue IMO. Appears to me there was nothing done to 56 and if the fight did happen that's a huge problem for jones under the circumstances IMO
 
In my line of work I have dealings with lawyers on a daily basis. I can guarantee you that the attorney filing this suit cares little to nothing about the victims of alleged assaults. He wants his 1/3 of settlement proceeds.

Why was Peyton included? Simply for national media. If Peyton's name wasn't included how big of a story would this be? Everything done including adding two more football players to the lawsuit the day of the coaches press conference is calculated.

It saves the attorney unbelievable time and resources if UT would just settle. Which is why so much negative has been floated. Worse case scenario is UT fighting it. Which in the actions and responses of Butch Jones during each alleged assault they should.

Disappointing that people can't see this for what it is...a money grab by an attorney out of Nashville using those involved in alleged assaults as his pawns. Simple as that

David Randolph Smith likes big visibility cases such as the crematory case out of North Georgia and suing doctors and hospitals for malpractice He and his small band of attorneys need to be schooled in this case. His money grab should bring back a nub
 
Good grief Basilio is saying Butchs status is up in the air right now hoping he is way off with that assumption. Of course his best buddy said on Twitter last night (vol colonel) that he would be coach for a long time. Insiders what if anything are you hearing? UT going to go to bat for our coach for once and not lie down to these money grubbing piece of crap lawyers and media?!

We are in dire need of some kind of litigation reform in this country. It is abused like crazy. And it ruins lives.

Overreacting a bit.

Basilio has went on record and says he knows for 100% fact that he called a team meeting and told the team that Bowles was off limits and anyone who messes with him will be dealt with accordingly.

Also, see the tweet I posted from Chris Low where UT judicial affairs interviewed Bowles and he said Butch Jones handled the situation properly.

Typically, nothing. Which is why they will push for a quick settlement, but any settlement will do. I guarantee you the plaintiff's lawyer does not want to try this case.

As a side note, I also guarantee that Drae Bowles will get absolutely destroyed if this thing goes to trial.

Basically nothing. He gets paid when the victims do. Of course out of settlement amounts he will get his 1/3 and attorney's fees. Plaintiff attorney wants to settle which is why it seems like everything that could possibly be negative has been floated

If the lawsuit and the stuff being leaked is proven to be bogus, are there any kind of repercussions for the lawyer? Or is he protected from any kind of countersuit? Tort lawyers frustrate me so badly.

You'd have to prove that not only the physical harm came but that curt wasn't punished. Both are hard to prove a year+ after the fact.

Keep in mind what a plaintiff lawyer calls an attack could and likely was just a fight. Calling it an attack gets them headlines. Always more to the story. If Bowles was truly attacked he would have pressed charges.

Plaintiff lawyers always spin the truth to make things look a certain way. If these guys had real evidence they wouldn't make this such a public message. They are putting bits and pieces of a story to fit an agenda which is $$$. You don't throw these things out there if you got real dirt

The discipline is easy as well to prove. This is part of the bs protocol that universities must follow when students are harmed. There would have been a required by law a report filed with proper officials.

I know things happen all the time on the lockerroom and boys will be boys but that thinking won't fly in this situation IMO

And if team members refuse to talk? If there is not record of an assault then there won't be punishment. If the punishment is for confronting him then there will be no paper work. Its not easy on the plaintiffs end at all.
 
After reading everything I can stand to read, I have concluded this:

This lawsuit was filed by some people who are mad at Dave Hart. They are trying to get even with him and are dragging a bunch of people through the mud to get publicity and hopefully some money. Hart likes a fight, so this will probably drag out for a couple of years, damaging our programs in the process. This is sad, but I don't think his ego will allow him to do anything else. He could damage the university more than all the bad coaches we have had added together.
