Those are very, very serious allegations contained in the Complaint. If the allegations against the individuals named in the complaint are not true, the Plaintiffs and their counsel have opened themselves up to defamation liability and malicious prosecution liability. There would also be separate legal ethics issues that would have the attorneys answering to the Tennessee Bar.
From what I can tell, the Plaintiffs' hired a reputable Plaintiffs' attorney to represent them in this. But after reading the Complaint, it is littered with allegations that, in my view, are in there for no other purpose but "shock value," and to gather media attention. Likely intended to put pressure on the University to settle right away.
it's a sad state of affairs if that is the case. From what little i see as an outsider, there are questionable folks in the legal community. I guess im old school and I view hard work an honest, ethical approaches to going about one's business as paramount qualities. The DUI attorney with their ads on a coaster days are here whereby one's attention seeking will garner new customers as opposed to the merits of actual quality body of work. its a damn shame and if the case the Bar should hole them liable.
i just hate that it takes a counter suit to recoup. How difficult is a defamation case to try? What are the Universities options?
