Those are very, very serious allegations contained in the Complaint. If the allegations against the individuals named in the complaint are not true, the Plaintiffs and their counsel have opened themselves up to defamation liability and malicious prosecution liability. There would also be separate legal ethics issues that would have the attorneys answering to the Tennessee Bar.

From what I can tell, the Plaintiffs' hired a reputable Plaintiffs' attorney to represent them in this. But after reading the Complaint, it is littered with allegations that, in my view, are in there for no other purpose but "shock value," and to gather media attention. Likely intended to put pressure on the University to settle right away.

it's a sad state of affairs if that is the case. From what little i see as an outsider, there are questionable folks in the legal community. I guess im old school and I view hard work an honest, ethical approaches to going about one's business as paramount qualities. The DUI attorney with their ads on a coaster days are here whereby one's attention seeking will garner new customers as opposed to the merits of actual quality body of work. its a damn shame and if the case the Bar should hole them liable.

i just hate that it takes a counter suit to recoup. How difficult is a defamation case to try? What are the Universities options?
 
So it is more important to spend funds generated from other people's pockets for unintended purposes of damage control for the football program, as compared to letting the justice system do what it is designed to do?

Do you want this to drag out? Settling out of court exists for a reason too.

Siap but good grief this suit goes all way back to PM mooning incident

Getting every media outlet including ESPN to discuss it is a shot across the bow. Throwing Manning in there is just to bring more attention. It's baseless but it will work in drawing attention. Two things: 1. these lawyers are some nasty mofos who are currently sending a message loud and clear to UT that they can and will make this messy 2. if I need some nasty mofos on my side I want them.
 
According to the video the manning incident is discussed as part of the "indifference" the university has shown over the years.

They're really grasping if they're that effected by mooning haha. Like said before, it's just to get PM's name out there for attention
 
Why is this only being brought against Tennessee? This stuff happens at every university and its repulsive everywhere. Why is UT the only school that is getting it's name dragged through the mud?

It's always something for us Tennessee fans. I really hope this blows over quickly but knowing the cluster that the legal system is this will loom for quite sometime.
 
I agree putting out Mannings name just for attention good grief! Hope Tennessee lawyered up good. Need to make this go away right now! Every day that goes by there'll be another scathing headline and salicious story. Right now there is an article on BR that has someone from Fox Sports asking about NCAA punishment that could come of this.

The NCAA won't get involved. FSU went through the same stuff and they are doing just fine. As long as Butch produces on the field this season everything will be fine.
I'm not going to put any blame on the school, players, or coaches until they are proven guilty in a court of law.

I do not handle cases in that area of law, but defamation is protected in litigation. A high majority of cases revolve around "disputed facts," and the legal system would have a problem if people could file defamation acts based on legal argument. A legal case by definition is a controversy.

That said, I believe there is a movement and some law to support a payment of fees and costs if a lawsuit is deemed frivolous. Not actually having any direct knowledge of this case, my guess is there is some proof that these type of things happened. Factually, it could revolve around how UT reacted to the incidents. It could end up being a legal issue. Even if the facts are true, do they still make UT liable? Does UT promote an atmosphere of sexual misconduct just because several players, at different times, were being investigated or charged with a sex crime?

To sum it up, while I don't care for the suit and believe UT should vigorously defend it, I don't believe these lawyers are just making up things and being totally reckless and unethical.

No. That's a pretty retarded question and Fox Sports already knows the answer is no.
