I really hope the coaches move Josh Smith to the slot permanently next season. I think he would do very well inside personally. Would ease a lot of the third down problems of our passing game at times.

"Reckless disregard" whether the story was false or true will satisfy "actual malice" in this case. If Peyton weren't a public figure, malice wouldn't apply.
The argument could be made that Ashley Manning isn't a public figure. She goes to great lengths to protect her privacy and safeguard her medical history. The manner in which she handled her pregnancy and the twins' birth goes to her strong desire to maintain her medical privacy and keep personal and health matters out of the public eye.

The guy, not knowing he's being recorded, says "We sold Manning these drugs" and gives a very explicit and detailed account of how they were delivered. Then, in the face of possible HIPAA sanctions(?) and losing his job and/or all of his clientele, he says "oh I just made it up."
I just find it hard to believe a judge is going to find that a story about a public figure is sanctionable because the source made a self-serving retraction.

How does everybody view the bowl season so far? I have been really surprised by the lackadaisical play of the some of the favored teams - especially on D.
