@ 2:15, the cop tells him to take his hand out his pocket. At this moment, the civilian has one hand in his pocket and the other hand holding the phone/camera

@ 2:21, the phone/camera goes side ways as he is still holding it, you then see that with his other hand, he places a cellphone and a set of keys on his pick up/SUV. At this point, anyone with common sense would realize that you can't hold a phone with one hand and put personal items on the hood of a vehicle simultaneously unless both of your hands are out of your pocket. It would also be easy for the cop as he is approaching to tell if the guy really has a gun
@2:26, we see the civilain is holding the camera/phone with one hand while he is back up and pointing/gesticulating at the cop with his left hand, meanwhile, the cop is backing him down with his gun drawn for several feet across the driveway.
