Von Pearson Update

You do spend a crazy amount of time in these threads insinuating that women who make claims against UT football players are liars.

The same could be said about the people in this thread labeling VP guilty without any evidence or facts.
I'm just voicing a different perspective.

What I am upset with is the fact that people are in fact getting punished before any charges are even filed.

Per Dave Hooker today, a source has told him that VP will likely not face legal charges. Her story seems sketchy apparently. However it is still up in the air as to whether the University will allow him to come back. TIFWIW

Pearson's Twitter account has been interesting the past few days. A lot of references to being sick of waiting. Makes me wonder if he's aware that the investigation is dragging out for the sake of appearing thorough and that charges will be dropped/he'll be reinstated just in time for fall camp. Although that would look kinda suspicious as well, wouldn't it?

So basically if you're a football player at UT you should just use your hand for 4 years, otherwise you run the risk of losing your entire career over some vagina that might accuse you of something.

Or maybe get a consent frorm signed before pants drop

I think a signed consent form is unnecessary. Nowhere is it stated that a document proving consent must be produced.

Thus, it is sufficient if a football referee, NCAA Compliance Officer, mediator, or other individual well-versed in settling disputes accompanies the young man and woman, and issues a ruling on the spot whether consent for sex has been given.

If consent, once given, is thereafter revoked, a whistle shall be blown and a flag thrown. Thus, auditory and visual indicia are given to the male that all activities are to cease and desist.

No trial. Unfortunately, there is no right to a speedy investigation.

He hasn't been charge, so there is no trial. You can't get a speedy trial if there is no trial. the university is just covering their butts so that it shows they did everything they could do before reinstating him.
 
I wish I were a lawyer and lived in East Tennessee.

Surely there is at least on Law School Graduate from the University of Tennessee who sees the injustice in this situation, and has the nads to do something about it. It is against the spirit and specific wording of the state and federal constitutions to allow Von Pearson to slowly twist in the wind like this.

If it's not a constitutional matter, fundamental fairness dictates that the young man be allowed to get on with his life knowing whether he will be charged with a crime or not. The damn Knoxville police may not like it, but they MUST be made to put up or shut up. The same goes for the District Attorney's office. Charge the kid so he can go to trial and prove his innocence, or cut him loose. They should NOT be allowed to HANG A DARK CLOUD OVER HIS HEAD INDEFINITELY. PLEASE...WILL A LAWYER STEP UP!!!!!!

The case is stalled at the beginning of the criminal process—filing of a complaint with insufficient evidence to arrest. If KPD can't establish probable cause to obtain a warrant, then it will progress no further. KPD doesn't have to close the investigation, and the DA's office does not have the case. Unless UT expels Von, the decision on whether to reinstate him to the team is up to CBJ and UTAD.

True. He could never be charged and also never reinstated to the team. The legal process could determine there is not enough evidence for a charge but UT could have enough for dismissal.

Since Pig and Mixon are witnesses, and UT has unredacted incident reports from both UTPD and KPD, CBJ has had key facts from the outset. Any idea what UT will do if the legal process stalls indefinitely?

Butch has a redshirt option for Pearson but Pearson may opt to go ahead and go pro. He is 24 so age is working against him if he wants to ty to be a pro.

If I had to guess, strictly my opinion / guess, I think he doesn't play this year and goes to NFL draft in spring.

Iirc, it was written in an article that they were being interviewed as witnesses. Seems like ages ago, so I may be mistaken.

Thanks for the input! Von opting for the draft would be my guess, too. I've read both incident reports and legally, the case is probably a nonstarter. But sexual assault is a hot button issue, so I can see where UT would take a conservative stance.

IDT they've been published, but they're public information, available by request from UTPD and KPD. The media and lawyers around town have them.

Six witnesses were interviewed in the initial investigation, including Pig and Mixon. I believe all six were students.

From the beginning we have known that CBJ spoke with Pig and Mixon, questioned them both, and what they told him factored into the decision to suspend Von.

Isn't it CBJ's policy to immediately suspend a player when he becomes involved in a legal investigation? It appears that Pig's and Mixon's statements were not incriminating or the case would have progressed.

If the case is unresolved , you think the NFL will welcome him with open arms? :huh:

There is no right to a speedy investigation. However, there are elections, and if the mayor can't appoint a police chief who is capable of conducting an investigation in a timely manner the voters should make their sentiments known.

Similarly, if the District Attorney's office can't get off the pot and decide whether to charge someone or not, the voters should express their displeasure.
