Theoretically, this reduces the likelihood they would take it because, assuming the full court does go the other way, there would be no conflict between the circuit courts to resolve. Not that the high court can't still decide in its discretion to accept jurisdiction, but it would not surprise me in the least if they turned it down on grounds it is a political dispute, not a legal one.
Not to mention the delay this is going to cause and possibility the issue will be fixed or otherwise moot.
With the amount of amending it would require they would be better served to repeal and start over. It's a giant, expensive turd
