They let him patrol the property with a gun, as their agent. Volunteer or paid has nothing to do with it. They could be sued vicariously, for his actions. And they could be sued for their own direct negligence in accepting his services.

It gets better. If a jury finds him not guilty for any of the homicide/manslaughter/negligence charges, the Feds can charge him with a civil rights violation.

The Fifth Amendment protects individuals from "double jeopardy" arising from government actions not from civil actions. Acquittal in a criminal case does not prevent the defendant from being the defendant in a civil suit relating from the same incident.
