She's not seeking money. She's seeking a declaratory judgment that the agreement is invalid. Then she will go tell her story to the highest bidder if she's successful

The media is making him bulletproof by printing so many false or slanted stories over the past 1 1/2. Now, no matter what they print, few take them seriously. They are their own worst enemy.

Most take them seriously. Only the people that bought into the "fake news" gaslighting crap from the beginning fail to take the news seriously. It's becoming increasingly obvious why Trump was intent on discrediting the media from day one. The truth makes him a felon and a despicable excuse of a person, let alone president.

My initial thought is that since Stormy signed and received compensation the agreement will be enforceable against her.

Yeah, I haven't researched this issue since I was a baby attorney (as you can imagine it doesn't come up often), but I think the rule is that a contract has to be signed by the person against whom it is being enforced. In this case, Trump would be the one trying to get Daniels to comply with the agreement.

That is accurate, but my next question is does Trump have standing since someone else did sign the agreement in Trump's stead. If his attorney had to bring the lawsuit that would be one big mess.

Regardless of whether she wins the lawsuit or not I guess we can interpret this action as the media announcement of her upcoming tell all book! Which is I’m gonna guess the whole intent.

True BUT as a practical matter Stormy actually has Trump by the short and curlys. If this goes to hearing, all that Trump can do is come out and actually admit that he is AKA David Dennison, which obviously defeats the purpose of concealing his identity. Cohen can't claim his client agreed to the NRA if there is no signature and it wasn't Cohen himself that is AKA the signatory Dennison.

Further, Cohen can't claim that he didnt inform Dennison of the charges and agreement to pay the hush money, because New York law requires attorneys to do so. Thus Cohen risks disbarment if he tries to cop that lie.

Moreover, guilt of the actual deed (Trump affair) is a foregone conclusion, else why would he pony up a $130,000 to shut her up.

In short, Trump is totally ****ed.

People haven't grasped the magnitude of this yet. Trump is facing felony charges. He and Cohen conspired to violated federal election laws.

Solid points. I don't really no much about the substance of the agreement and did not realize that Trump supposedly used an alias. So, Stormy may win on a default and get out of the agreement. That is a pretty solid strategy by her attorney.

This would be a huge deal with literally any other president/politician, but especially president. But there are so many scandals associated with Trump I guess we all are desensitized by this point?

I'm curious who will be the first Trump supporter on here to say "It's reached the tipping point, I can no longer support Trump." Surely, someone will rise to that conclusion.
