I would consider a link on his website to be publicly provided photo. I am sure the one you buy is much higher resolution. All I did was provide a link from the website to the photo they have listed.

The photo is copyrighted unless he himself signs over licensing rights. There is no implicit loss of licensing rights when someone posts your photo on the internet.

That is quite possibly the best aerial shot of Neyland I've ever seen. It would make a fantastic huge canvas print (and I'm sure the photographer would be glad to sell you one!).
