What else can he say? His problem is that if you define whether its a regulation by the incidental effect of taxes, you can justify ANY presidential action as "regulation."

Gorsuch is having second thoughts about manufacturing executive powers out of thin air that aren't in the Constitution.

it won't be the first time, and sadly it probably won't be the last.

and remember some chicken littles said that the Supreme Court was going to let Trump do whatever he wanted.

Yeah, that is one guy that is confused on taxes to start with. With that said, I would not be surprised by a negative outcome.

Congress continues to fail at their job decade after decade.
 
Well hey it took him a few years but he finally figured it out!
Oh I’d guess Trump will take it as a challenge and double down on tariffs honestly. But it will be glorious to watch world leaders give him the finger in response while holding up a copy of the ruling.

I think if the admin is smart the could use a ruling against the tariffs to put some serious pressure on congress to do their damn jobs.

There are other statutory tariffs that can be used if I remember correctly, but they are more limited. The admin could possible go the sanction route, but that also gives less ability to fine tune.
 
Very skeptical that those partisan hacks Thomas and Alito will rule against Trump...
I think you’re right but if they do that would be a final indicator of just how huge of an executive over reach f$&@up this was. A 7-2 ruling would still send a very clear message to anyone who knows the history of the justices.
