2A?LOL. The admin is out of control for not applying laws based on race. Good one.
It was not "at worst trespassing". It appears to have been a conspiracy to deprive a group of their right to exercise their religious freedoms. Lemon was nice enough to stream the conspiracy parts and narrate it for us while it occurred. His 2A claim is BS. Just because you live stream your crime does not make it a 2A protection. Try live streaming a rape or mugging and see if you get 2A protections.
Does the FACE Act apply though? It not being applicable may well have been the reason for the refusals to issue warrants. Otherwise, why refuse? And that is Lemon's problem here. He was asked to leave along with the group he came with, his response was "it's ok I'm allowed to do this". At that point it can be argue he was no longer documenting the mob in the church, he became part and party to it.
Yes, a journalist can enter a church and document services, but their rights are not absolute and they are subject to the same laws as the general public, particularly concerning trespassing and disruption of worship.
Key Legal Principles:
- Private Property: A church is considered private property, not a public forum, meaning representatives can ask a journalist to leave, and refusal to do so constitutes trespass.
- Freedom of the Press: While the First Amendment protects the press, it does not confer a special, unrestricted right to access private property or places not open to the general public.
- Disruption of Worship: Intentionally interfering with or obstructing a religious service is illegal under federal law (such as the FACE Act, 18 U.S.C. § 248) and various state laws.
FYP ….. now it deserves a likeOk, that's a problem.
I agree that private property is private property and if he was harassing people then yeah he should have been arrested.
But I'll wait to actually hear whether that really occurred.
Truth is a very slippery thing to discern these days with EVERY administration
Not sure that’s even relevent he’s a person not a vampire. It’s private property if he’s told to leave and he doesn’t he’s trespassing
They were all mostly peacefulProbably because there were like 12,000 protests and 95% didn't involve violence, but go ahead post them.
Not sure, I think there's some question at least. But if you are asked to leave and you do not you are trespassing. And then furthermore telling people you have a right to do what you are doing even after you are asked to leave becomes harassment.Does the FACE Act apply though? It not being applicable may well have been the reason for the refusals to issue warrants. Otherwise, why refuse?
