I'd like to hear a defense lawyers take on that argument, if any would use that in defense of a client. "You're honor the arrest was illegal since my client was arrested by an ICE officer" "it doesn't matter that the officer saw my client stealing the car the case has to be dismissed".
Like a citizen, they would have to 'hold' the individual until local LEOs came and detained and read miranda.

That is a guess.

No dang it. They are ICE, FEDERAL law enforcement so they can't arrest you unless you are committing a federal crime. They would have to call a citizen to do it....
Or… you know… call a LEO with property authority on the radio and observe and gather deets until they arrive? But sure we have to go all histrionics I guess 😘

The counter to the heupel-thetical is if an ICE agents was there and could have stopped the crime, would he/she bear some legal responsibility if they chose not to intervene?

Good question. I could see the press conference when an ICE agent failed to stop a murder. "Murder is a state crime and our officers have no jurisdiction".

Needs refining. At station they are TSA and subject to their authority limits. At lunch sure go for it.

Also I’d submit the offense being observed matters. Jay walking, parking ticket, or even car theft which I referenced their authority limit applied. If they’re about to batter or kill another person I’d be shocked if exemptions didn’t apply. Just a guess

Madman who beat up pregnant woman is among anti-ICE rioters arrested outside Minneapolis hotel​


A sicko who once beat up a pregnant woman and a notorious thief were among the scores of anti-ICE agitators arrested when a protest outside a Minneapolis hotel where federal agents were staying descended into chaos.

The rap sheets of those involved emerged after at least 26 protesters were cuffed at the SpringHill Suites in Maple Grove on Monday night when demonstrators started destroying property and hurling objects at law enforcement.

Among them was 37-year-old Justin Neal Shelton of St. Paul, who was nabbed on charges of obstructing legal process.

His prior run-ins with the law date back to 2007, when he pleaded guilty to bashing a pregnant woman as he tried to steal her car, Fox News reported.


During the savage attack, Shelton and another perp knocked the soon-to-be mom to the ground, kicked her and struck her with a bottle.


Shelton, who ended up being slapped with a five-year prison sentence for the savage beatdown, was also convicted of possessing a firearm or ammunition after committing a violent crime in 2020.

Abraham Nelson Coleman, 45, who was arrested for damaging property outside the hotel, also has a slew of prior arrests.

Since 2003, the Minneapolis local has been convicted of multiple theft and property damage charges.

Others, meanwhile, have openly signaled support for anti-ICE demonstrations — including 21-year-old Rayna Michelle Alston, who has the phrase “disrupt disturb resist” brandished on her Instagram.

Alston, who was arrested on charges of riot following the hotel saga, has previously supported a nationwide shutdown as ICE protests boiled over across the country.

Where did you get the notion that a federal employee with limits to their scope would be prevented or acting illegally if intervening in a state crime?

I also agree with your 'nature of the crime' makes sense. Even thought there may not be a legal distinction, I find your scaling of the offense to be reasonable.
 
I did the same thing on FB. I was done with it. Then I just started muting my friends who talk politics too much (I rarely talk politics on FB) and it's actually pretty fun now. I follow a bunch of s***posting accounts for my favorite TV shows. Those communities are hilarious.
Same. follow things on FB and get kicks out of some of the feeds. Very rarely ever post. Maybe 5 total ever, and no where close to the ballpark of politics and job loss stuff. That junk is out there forever when you go be publically stupid. Not so restrained on VN though, but never posted anything that would get me fired or doxxed if discovered. Except that I don't hate UGA cause they paid my dads paycheck for over 30 years and had a decent life because of his job. That may get scrutinized.

Their past and the rap sheet have no bearing on the circumstances of the event and it does not justify what the agents did.

In responding to OC on ICE authority limits. It’s come up multiple times over the last five days or so so I googled ICE authority.

Likely why they immediately label everything domestic terrorism, to be within the scope of DHS.
Not sure where you’re going with this. If you are implying they use exaggerations to justify their actions I’ll agree. I’ll submit the ridiculous comments from the two idiots Noem and Bovino up until yesterday as evidence of that.
