Yes, always thought of felony murder in the scenario of someone robbing a gas station, and then shooting the clerk during the commission of the robbery - “felony” murder.

Irrespective of whether there are predicate crimes to trigger a felony murder charge, does this look more like 1st or 2nd degree in your opinion?
I mean, in Tennessee, if you drew the appellate review standard as a Venn Diagram, I think it would basically be two concentric circles. Courts have basically made the line between those two “whatever the jury says it is” with some legal mumbo jumbo window dressing.

Legally, I would have a hard time finding premeditation based on what is out there. But if I’m on the jury, I’m not gonna spend a lot of energy trying to convince my peers that pulling a gun isn’t “premeditation formed in an instant.”

Believe the kids call this receipts. Just shows, the left doesn’t care about Good or Pretti. As they didn’t care about illegals killing Riley and Morin while choosing to stay silent. Had they spoken up years ago when illegals entered and killed, they would look better today. But they didn’t, they allowed it then and now the chickens coming home to roost.

But if you are desperate to apply it to this situation....if no one had had a gun in MN, no one would have been killed.

I guess you are suggesting that the legal concealed carry law should be revisited.

I think the "felony murder vs voluntary manslaughter" argument here boils down to the first shot.

If the officer(s) that shot him approach it as "we were attempting to arrest a subject who was fighting us, and we observed he had a firearm, but we heard a shot go off (and we didn't know it was from the suspect's gun malfunction discharge in another officer's hands) then I was in fear of my life because I thought the guy was shooting at us"

That probably won't protect them in an actual court case from charges, but doesn't rise to felony premeditated murder either

How so? I am not even saying the guy shouldn't be able to carry a gun. I am simply pointing out your typical hypocrisy which your principles only are dictated by which political side has the behavior
