I'm not trying to pester of be combative. They were genuine questions, asked in good faith. No worries if that was the limit of the conversation.
I'm not being snarky either. I think a conviction on anything substantive is unlikely. I believe the best recourse is in civil court where the church is likely to win.

That's why I was pressing. I'm open to opinions as to why a conviction is unlikely, short of "No one's going to want this political hot potato". In my view, it seems pretty clear that he live streamed himself as part of the group that planned it (conspiracy), and took part while it was ongoing. I hate the idea that just because someone was a quasi-recognizable celeb, or because they are a liberal mouthpiece, they are exempt from the law. What would make him more protected than any other random YouTube streamer?

Sen. Susan Collins says ICE has Ended Enhanced Operations Maine​


Jan. 29 (UPI) — Sen. Susan Collins announced that Immigration and Customs Enforcement have ended enhanced enforcement in Maine.

Collins, R-Maine, said she spoke with Secretary of the Department of Homeland Security Kristi Noem, who told her the news.

“I can report that Secretary Noem has informed me that ICE has ended its enhanced activities in the State of Maine,” Collins wrote on X.

 
This is probably the most reasonable and balanced review that I've seen of the Pretti situation. One thing of interest: it sounds like, if the officers involved were familiar with Pretti from the week before, his actions/outburst may be a contributing factor to the "reasonableness" argument of the agents' use of deadly force. He didn't specifically say so, but he did describe that things an officer may know about the subject's temperament/history becomes important under the "totality of circumstances" portion of SCOTUS ruling. IOW, it sounds like if they knew he was someone who had displayed anger management issues, or problems with impulse control, that would be one more admissible fact ion the agents' defense that they reasonably feared for themselves in that situation.

And ironically, it sounds like all of the horns, whistles and yelling may work in the agents' favor.

To be blunt, it sounds like a prosecutor will likely have to produce more evidence than what we have now (or find 12 people who are very sympathetic to Pretti) to get a conviction.
