That would be for the store owner and the security guard to decide. I'm pretty sure choking the man to death wouldn't come into the conversation.

Likely, the guard would approach him and tell him in a polite manner to move along. Although, I personally see no problem with him being on the sidewalk, that's a public area, if we're using today's standards.

I'm done discussing this bc we will never change each other's minds but I do think you would feel differently if you was a store owner.

A call that was bogus as hell. If someone was indeed robbed, they'd run to the officers as soon as they arrive. That didn't happen.

and the cop is just supposed to know this upon receiving a radio call that there is an ongoing robbery as reported by a witness?

1. you should be angry at the person making the call not the cop.
2. you should be angry that the kid ran and escalated the situation. if you stand calmly that is the reaction you get the same from the cop.
3. If that had been a real robbery the cop reacted the correct way. Unless I am missing the part of the story where the cop beats the kid senseless.
4. Lets say its you in this situation. some old lady says help that man just robbed me and you are in the position to tackle him. Do you? and if you do, are you justified? If yes to both or at least the second then so is the cop in this situation.
 
I would not be surprised if this was a set up. Guys acting suspicious, waiting for cops, running, resisting arrest while buddy just happens to be right there filming. All topped off with an over the top performance with crazy, high pitched yelping and obviously resisting while claiming he's not resisting.

Something just doesn't sit right with this situation.

what i don't get is how long does it take this guy to withdraw funds from the ATM. Guy walks up and is there long enough to be suspicious, long enough for someone to make a call, and long enough for Officer Doughnut Joe to get the call and get there and respond while the kid is still in front of the ATM. I wonder if the guy filming was the guy to make the call.

Yep. Thought this as well. They were there way too long. It just seems a bit weird....

depends on the city ordinances. In the cities I have dealt with if you are allowed to sell in front of your store you are responsible for the sidewalk out to the curb. That would require a deep enough side walk and a host of other things. now if the store isn't allowed to sell in front of its property its a public right of way. and if Garner has set up in a manner to restrict pedestrian traffic below the minimums required, again a city reg, maybe even other considerations, any member of the public could be within their rights to remove the obstruction. depends on the city regs, but with what I have dealt with it is completely allowable to require him to move as he is interfering with the general public at that point.
 
It is no wonder some people are so twisted. Watching that video makes me wonder what kind of people seek such garbage. The pendulum will swing.
