The Supreme Court of the United States Thread

I've only criticized her for being uneducated. I know 2 year old who knows what a woman is, but if you want an uneducated person making decisions for our country, then you need help also. You also sure do seem defensive about people wanting pedophiles to receive what they deserve.

I think you’re the 4th person to casually associate me with a pedophilia because I’m pointing out that certain people lose their minds when even accusations of pedophile adjacent behavior are raised.

Aside from the fact that you’re proving my point, I think it’s time to start considering that “objects in mirror are closer than they appear” warning on that lens that shows QAnon getting further and further in the rear view mirror.

The guidelines are not law. They’re not binding.
They aren't? Are you saying the guidelines are not mandatory, only advisory? If so then all the senators grilling her need to go back to work and make them mandatory.

What is a mandatory minimum?
A mandatory minimum is a sentence, created by Congress or a state legislature, which the court
must give to a person convicted of a crime, no matter what the unique circumstances of the
offender or the offense are. Typically, mandatory minimums apply to gun and drug crimes and
are based on only the type and weight of the drug involved or the possession or presence of a
gun.

When were mandatory minimums created?
The current mandatory minimums for federal drug offenses were created by Congress in 1986
and 1988. Over 260,000 people have received mandatory minimums for a federal drug offense.

What’s the alternative to mandatory minimums?
Sentencing guideline systems created by expert commissions. Guidelines typically give courts
1. Sentencing ranges for each crime (i.e., 51-63 months in prison) that depend on the
offender’s criminal record and the seriousness of the crime, and
2. Flexibility to sentence inside, above, or below that range, if there are special facts and
circumstances of the offender or the crime.
The federal system and many states have sentencing guidelines, in addition to their mandatory
minimums. Guidelines can be either mandatory (courts must follow them) or advisory (courts
can choose not to follow them
, when the facts call for it). Well-written advisory guidelines
provide judges with reasonable sentencing options and are fairer and more flexible than
mandatory minimums.

The child porn one aren't mandatory. Again I heard something about SCOTUS making them advisory on the ruling but haven't looked it up to see if that's true or why.

There is some work to be done on the legislative side to be sure and I've already emailed my rep and senators about it. We will see if I get a response.

Thanks, Anon, did I misspell it somewhere or is sentencing pedophiles now directly pedophilia?
You referred to yourself as "a pedophilia". Which doesn't make sense. The word you should refer to yourself as is pedophile. Because you're a person, allegedly. Unless you're one of the lizard pedos. Since you describe yourself as a lawyer, that is certainly possible.

I would assume federal guidelines would be #1 and prosecution recommendation would be #2. If they’re convicted what else is there to consider?
The defendant makes a recommendation as does the probation office. In these cases, none of the four is binding.

There are a ton of factors that go into determining what the guideline range is and then more that go into determining where within the range the defendant falls. The parties don’t agree about whether these factors all apply and may reach different conclusions about which ones apply. It’s not like there’s some oracle that spits out the guideline range.

Then there are roughly half a dozen other statutory factors, including several with multiple subparts, that are considered alongside the guidelines. There’s no direction, that I’m aware of, as to how those 7 things have to be weighed vis-a-vis the others.

@Wireless1

Pedophiles have the same intent to hurt a child as a person charged with 1st degree murder which carries a lifetime sentence. Those that participate (watch a murder ie watch child porn) are also jailed for longer then current guildlines. The guidelines need to be changed...period. as for the death penalty...if its 100% provable and caught on tape. Kill em. If there is even a chance it not 100%, jail them for 30 years and chances at appeals if they cant prove innocence after that leave them there

Oh my bad, the a was the typo. Others casually associated me with pedophilia. I think you’re the only one to go full QAnon and call everything you don’t like a pedophile.

Now we’re getting to the absolute banana pants nonsense that I come here to see.

“I’ve been sold this narrative and it’s my sworn partisan duty to defend it, let’s see what weird **** I can make up to get the job done. I’ve got it! Life in prison for watching a murder! That’s a thing right? Should I check into that? Nope. Who cares, it’ll work.”

Its called felony murder...look it up..those involved in a commission of a crime in which a murder is committed...the sentencing is not for life, but I'd argue that those found guilty of that are far less likely to commit murder in the future as opposed to that watch child porn..

The only problem with that is how many have been found guilty that weren't?
I get that, I just mean guilty without doubt. Like the dad in Texas catching the guy in the act and killing him, purely justified imo.

I'm still not sure what qanon is all about, but it seems you liberals are obsessed with it

If that’s the case it’s way more complicated than it needs to be.

This explains why republican presidential hopefuls think that throwing out baseless accusations of light sentencing for pedophiles is their ticket to more votes.

😂

Watching a video of a murder is not felony murder.
