Sweeping Sexual Assault Suit Filed Against UT

I do too, but I also believe the alleged victims should be allowed to do the same without harassment from the alleged perpetrator, his friends, team mates, coaches and other school officials. People in the athletic department have no business calling on alleged victims. There is no scenario I can think of where the football coach should talk to either the victim or their families, nor should players or their families be offering up their opinions or advice.

This lawsuit, at it's core, is about the policies UT uses and whether it complies with Title IX.

Where the accused here in some cases have been allowed to stay in school, go on to graduate (regardless of their status with a team) it appears all the alleged victims left Tennessee either because of harassment or inaction leaving them with a hopelessness that it will carry on forever.

So while I agree with you, everybody deserves their day...if the players get to stay in school, the school should make every effort to protect alleged victims and it's pretty obvious they have not done that here.

As for your assertion that the lawsuit would have merit if they'd have allowed him to continue on, I find it incomprehensible that one of the most sacred principles in the our criminal justice system, holding that a defendant is innocent until proven guilty is now considered grounds for a lawsuit. Your perverted view of individual freedoms and rights is beyond belief. Typical of the PC crowd....it's always about genitalia. Incredible what a mess our country has become.
The university can have an investigation separate from a criminal proceeding and make a determination. I think this is the opposite of the pc crowd. If you are a business owner and one of your employees steals you don't wait for a trial to terminate. If you have conduct violations you conduct an investigation and make a determination.
 
The Title IX investigative process is a sham. The schools cannot possibly conduct a legitimate investigation, as they don't have subpoena power. It's nothing more than theatre.

That said, from everything I've read and heard, UT handled it about as well as could be expected. This is not a Baylor situation.

I can tell you, this is is not so.

You can sue anyone for anything......typically there are some sleazy attorneys working behind the scenes hoping for a big $$$ payday. Case in point.....yesterday I received one of the Class Action postcards in the mail regarding a Whirlpool Dishwasher I no longer own. If I become part of the lawsuit I can receive a 15% discount on a new Whirlpool Dishwasher....WOW. But if you read the fine print (which I did) it stated the attorney who filed the Class Action will request $19 MILLION for their fees.

And attorneys wonder why people hate them! :thud:

But you cannot operate from the assumption the two situations are the same. The paramount concern in these cases must be the welfare and justice for a VICTIM of a predatory sexual assault. Has to be. Otherwise the entire system of justice is undermined from the get go. Far better to protect the few false claimants than to destroy a single true victim.

TERRIBLE! May you never be the actual judge in court! There should be no injustice PERIOD

I have read Anita Wadhwani's garbage and remember specifically that one of the accusers never even bothered to go to the police. This is a money grab... nothing more or less.

What does this have to do with Anita whoever? This isn't a story, it's a filing to a court.

I've not read the full complaint, but are you asserting that it is factual and not simply allegations? These women are alleging that they were wronged by the university. Would that not be the correct way of stating it until a court has ruled on the case?

So you are saying that a player not found guilty, should be booted off team?

Has CBJ kicked anyone off the team, regarding this, or any other Crime, without that person being found guilty in a Court???? I sure hope not-that would make him look like a complete idiot-having knowledge of a crime, and using his position to "cover it up", may be a crime in and of itself. It does not matter who committed a crime, football player, or street sweeper, the law should apply to all Americans.
 
Person goes to a bar, picks up a woman, goes home with her and they have consensual sex. Women accuses man of rape, presses charges or files a civil suit. Man's name is drug through the mud. He loses his job, his friends, families and community thinks he is a rapist. His life gets wrecked. Shouldn't there be recourse and compensation for him when he is found not guilty?


That's why God didn't intend for us to meet at bars and immediately go home to have sex.

Outside of them accusing UT of harassment how do you know they did? The admin. is allowed to have an internal investigation (in part to know if should kick player off team or wait til court) so they can question BOTH THE ACCUSED AND THE ACCUSER.

I'm certainly not asserting anything based on this one document as you rightly say, until the plaintiffs have their day and it's adjudicated I guess nothing is a fact.

I am saying that one cannot simply blow this off as a "money grab" by a bunch of hussies because it's happening at "the school whose athletic programs I support".

Plaintiffs attorney David R Smith is a well known 'big case' Nashville attorney who loves the limelight and media who is counting on riding this new feminist sexist wave issue to a big payday.

I hope what they (the 6 women) alleging is NOT TRUE, as if it is, there is not an excuse or justification that would make it okay. In fact, if rapes and/or sexual assaults are taking place, there should be arrests, GJ true bills, and prosecutions, just like there should be for any other American citizen-playing on a football team, (even ours) in no way gives anyone the right to rape.

I think you jumbled your thoughts, because that made no sense. Has he kicked anyone off team... yes. They do an internal investigation, and if he (player) was even acting in manner that would be worthy of discipline, he can kick off team. He does not have to know that player raped someone. They question BOTH THE ACCUSED AND THE ACCUSER btw.

I agree with your second paragraph, but you have asserted your opinion that UT mishandled this as fact rather than represent it as just your opinion. Allegations are easily made, but that doesn't make them true.
