BBC News - Sony launches legal action against PlayStation hackers

But George Hotz, one of the hackers at the centre of the controversy, told BBC News that he was "comfortable" the action would not succeed.
"I am a firm believer in digital rights," Mr Hotz said.
"I would expect a company that prides itself on intellectual property to be well versed in the provisions of the law, so I am disappointed in Sony's current action.

Also mentions that the case against that California kid that was modding 360's and even selling copies on Craigslist was dropped.

In December, meanwhile, federal prosecutors dropped their case against a student accused of pirating games for Microsoft's Xbox 360.
The case against California resident Matthew Crippen was dropped after the judge said that he had "serious concerns" about the legality of the evidence collected against him.

I can't see what case they have, they act as if you are more or less leasing the PS3 from them, and it remains their property even though you have paid for it.

Hackers are fine but cheaters are a word I cannot say here.

I believe the hackers they are referring to are the ones that MOD their system so they can download games for free and play them.

The only place they can get you is if you connect your modded system to their online service. When you connect to their online service, the Terms of Service should make it actionable... at the same time, I don't see them being able to afford taking modders to court for connecting to PSN or XBL. That would be insane.

I agree with Sony in some areas. If you are playing an illegal copy of a game on their servers, they should be able to boot you. I don't think they should be able to do anything to you if you buy their console, then mod it. It's your property. It's just a hard line I guess. You could argue that who knows if that pirated copy has a bug in it somewhere that could disrupt their servers; However, the same could be said about MODding a console and putting OSx or Windows on it. You should be able to do what you want to your console, but they have the power to boot you if you aren't complying with their TOS...
