Not necessarily. As I stated above, it is not uncommon for these type of cases to go straight to the GJ. However, as you insinuate, in TN, if a DA wants something indicted, then it almost always happens.
I think it is different in different jurisdictions. Don't know the norm for Knoxville. Here, presentment are not "rare" but I would say 85-90% of cases start in Sessions.
My main thoughts are that it's obviously not a cold case, there's a victim, FSU and UVA are in the news big time, both defendants are from out of state, DA is brand new.
I think if you have a case, you want both to make a bond. You want to be seen doing something about it. Here, you'd want a judge ordering no direct or indirect contact with the victim. You probably wouldn't quietly submit it to the grand jury without some kind of fanfare. This is just LWS saying this, not even Hubbs.
On the other hand, if you don't have a case, you don't want to be seen declining prosecution with Rolling Stone articles and Jameis Winston memes all over the Internet. Let the grand jury do your dirty work.
