One group of "experts" strongly disagree with you, and they unquestionably trump all the talking heads you saw on ESPN or wherever. Emmert, the president of the NCAA, backed by the legal staff of the organization, wrote a letter to the president of PSU that cited a number of specific violations of NCAA rules by PSU including the lack of institutional control (LOIC) that is usually cited as the basis of all death penalty cases. In both that letter and in a statement made yesterday, Emmert specifically stated that the death penalty is in play.
When the president and AD of PSU were informed of the 2001 incident with Sandusky, they correctly decided that the authorities had to be informed about the crimes, but after talking with Paterno, they changed their minds and decided to cover it all up instead. That is textbook definition of a lack of institutional control -- when the coach overrules the president and the AD, then the coach is running the show rather than the president and AD, who the NCAA mandates are to oversee the football program. That is an open and shut violation of LOIC, the most severe violation of NCAA rules possible.
Folks here are in denial if they do not think the NCAA has any reason to be involved here. If you persist in not understanding it, you need only to read Emmert's letter. I personally cannot think of a situation that warrants the death penalty more than this one, and will be surprised and disappointed if that is not the ruling of the NCAA when all is said and done.
