I think that argument should have been made with regards to Title 9NIL is not governable. It’s what someone is willing to pay you for endorsement. Revenue sharing is different but all they would have to do is pull up the profit and loss report for athletic departments and you would be laughed out of the courtroom. You don’t get the same revenue because your sport is actually costing the schools money.

NIL is not working out like it was billed. Supposedly NIL would work like this:
Heupel recruits Nico. Haslam goes to Nico and says "I'll pay you $2mill to promote Pilot gas if you come to UT". If Nico wants more money two years later, he calls up Haslam and negotiates another NIL deal or he breaks his endorsement contract and goes to UCLA or whatever. I don't think that's how it actually worked
