Obamacare Survives SCOTUS

It would seem a fitting end to Trump's rein of stupidity that SCOTUS b*tch slaps him and the GOP on the way out the door.

Not only did Chief Justice Roberts lay the smackdown, but also Kavanaugh. Bravo!

"Chief Justice John Roberts and Justice Brett Kavanaugh suggested Tuesday that it wasn't the Supreme Court's role to invalidate the entire sprawling, 900-page Affordable Care Act, even if one or more provisions are deemed unconstitutional, signaling the key parts of Obamacare will survive the latest court challenge.

As the pandemic rages, President Donald Trump lashes out at election returns and President-elect Joe Biden prepares for a new administration, the Supreme Court heard oral arguments to discuss whether to invalidate the linchpin of the nation's health care system.

The Trump administration and several Republican-led states are asking the court to strike down the law, 10 years after it was passed, potentially impacting millions of Americans. Should Roberts and Kavanaugh, at the very least, side with the court's three liberals, the law would remain intact.

Roberts said simply that if Trump and Republicans wanted to kill the law, they could have done it.

"I think it's hard for you to argue that Congress intended the entire act to fall if the mandate was struck down when the same Congress that lowered the penalty to zero did not even try to repeal the rest of the act," Roberts told the attorney representing Texas, one of the states fighting the law.

The Affordable Care Act (ACA), often referred to as Obamacare, was upheld by the Supreme Court in 2012 and again in 2021, according to Retina Today and the Center on Budget and Policy Priorities. While the Supreme Court initially upheld the individual mandate, it later ruled that it could not be enforced as a command due to a lack of federal authority to mandate individual purchasing of health insurance. However, the Court still found that it could be enforced as a tax, and this was the primary way it was upheld. The ACA continues to be the law of the land, and recent court challenges have been dismissed.
 

Trump Administration Makes Sweeping Changes To ObamaCare, Ends ‘Dreamer’ Coverage​

The Trump administration is shortening ObamaCare’s annual open enrollment period and ending the law’s coverage of immigrants who entered the U.S. illegally as children, according to a final rule announced Friday.

In addition to the shortened enrollment period, the administration said it is ending ObamaCare coverage for immigrants who came into the U.S. illegally as children, also known as “Dreamers.”

The provision will undo a Biden-era rule that was estimated to allow 147,000 immigrants to enroll in coverage. A federal judge blocked the rule from being enforced in 19 states, and it is still being litigated.

The administration also banned plans from covering “sex-trait modification” as an essential health benefit beginning in plan year 2026. The policy will apply to the five states that currently include coverage for gender-affirming care, as well as in states that do not have such coverage expressly mentioned.
