I suspect they won't strictly enforce this, as to not risk ruining relationships with innumerable devs and publishers. They'll probably just do it when they feel their profits are seriously threatened.
Obviously Nintendo won't take this too far. They'd have a hard time enforcing such a patent at the various informal gallinaceous bloodsport arenas tucked away in the barns and back yards of rural areas.
