There is big money involved, so no party with skin in the game is going to take action that makes fans happy, except paying for the best talent possible. Having the president, with Nick Saban whispering in his ear, issue an executive order to 'fix' the system isn't going to help matters. It won't survive a court challenge, because Congress has the jurisdiction here. Only they have the power to regulate interstate commerce, address the anti-trust concerns, and control the use of Federal funds, which gives them a lot of leverage over public and private universities.

I do think a dedicated effort in congress placing the entire nation under the same NIL rules will make for some strange and fascinating bedfellows. Would party lines matter more than the self-interests of cash cows in-state? Small, non P5 and lower-tier P5 schools, states will want lower limits on any funding rules. Representatives and senators from Alabama, Ohio, Michigan, Georgia, and TN will want liberal rules on spending. Reps and senators from states like Indiana (will be interesting because the state university and Notre Dame will want different things), Iowa, Utah, and West Virginia will want an artificially leveled playing field.
