Taking the counter argument, what would happen then if a cop thinks his intervention would result in a perp getting killed? Maybe he would let you be killed to stave off that potential.
This is just like the old joke. To paraphrase: 'Now that we have established what you are, we are haggling over the price.'It’s become overly broad. It’s emboldened bad, or inept, law enforcement to blatantly violate peoples rights because they know they are almost guaranteed to be protected. In your instance it seems likely immunity would be justified. I think there are other instances where the officer should have immunity but the government still be held responsible, mainly property damages. No doubt they have a difficult job but the bad ones need more accountability.
