KNOXVILLE, Tenn. -- Though Tennessee agrees with most of the allegations made against it by the NCAA, the university argued in its response to the association that some of the violations should be considered secondary instead of major.

The university also said it tried to do a better job monitoring the recruiting phone calls that got it into trouble.

In the response filed May 20 and released recently to media, the school says it considers the basketball staff's impermissible off-campus contact -- or violation of the NCAA's "bump rule" -- a secondary violation.

The school also says the approval of lodging expenses for three basketball recruits whose visits in Knoxville lasted longer than allowed and some impermissible calls made by former football coach Lane Kiffin's staff should be considered secondary.

It really doesn't matter what we consider secondary if you ask me. The NCAA wants to play God with all the programs and there's nothing above them to keep them in check. So, if they say its major, its major. "Officer, even though the speed limit sign says 70, I don't consider 80 technically speeding..."

I understand and agree. Just a little something for you. According to a cop friend, you have a leeway of up to 9mph above the posted limit but it applies only to 25mph+ speed zones. My driving experiences cross-country seem to back this up even when I pass patrol vehicles under these circumstances.

So if I get pulled over for going 79 mpg in a 70 zone, will my argument of "a friend of a cop of a guy on volnation.com said there's a 9 mph leeway" hold up??

I don't think the punishment will be anything worth noting. Doubt Fottball loses any schollies at all.

Bball maybe...but doubt anythigin worse than the two years probation already in place. Most of this should be on Kiffin and Pearl.

Not legally, the speed limit is the speed limit. If it is 70 and you go 71, you are breaking the law. The officer can choose to ignore it, but he can cite you for going 1mph over.

The actual legal speed range is 10mph below the posted limit, up to the posted limit. So in a 70mph posted zone, you can do anywhere between 60-70. This is only under ideal driving conditions though. That's part of the reason that you really have to be going way under the posted limit to be pulled over, because "ideal conditions" are a somewhat grey area.

As an insurance agent licensed in 22 states, each individual traffic stop no matter 1 MPH over or 30mph over is going to ultimately end in the officer's judgement and how he wants to handle it.

Yea and you'd have to prove the radar gun's calibration is off. Good luck. :good!:

Actually I think the burden of proof is on them. If you question the radars calibration, they have to prove that it has been calibrated within so many days/months. Innocent until proven guilty.... or is that they way it still works in America? :) :yes: :)

Actually, that is true. The radars are calibrated every 12 months by a factory tech and they are tested by the officer before every shift.

As crappy as it is going to be to be put on official probation by the NCAA and to get punished...it is going to feel DAMN good to have all this negative press and speculation IN THE PAST!
