Acutally I'm not confusing it with a warranty.

1. A guarantee is always free. A warranty attracts charges as the insurance policy.
2. The guarantee is a commitment to make good defects of a product or a service in a fixed period. A warranty looks after the repairing of a new article within the validity period.
3. A guarantee is a legal contract without any payment. A warranty received on payment is also a legal instrument with which the seller can be brought to books.
4. A guarantee is an addition to the legal consumer rights. A warranty does not affect the rights under the consumer act.
5. A guarantee is applicable irrespective of the provision of the warranty. A warranty is free to go together with a guarantee issued on the same article.

in the context of a guarantee, you must make good on your promise. If he guarantees a win, or as you say promises a win, he must provide something if he doesnt do as promised.

This cannot be a warranty as there is no money exchanged to the player to ensure the win. That's a whole bucket of poop that we dont want to get any player into.

If Couch was guaranteeing a refrigerator he was selling, you might be right (many caveats to discuss, including the UCC and it's application to guarantees). However, Couch isn't selling refrigerators. There is a difference between goods and personal services.

Recheck again. A guarantee is for good or services. This would fall under the services part. "I guarantee I'll represent you in a court of law". "I guarantee we'll beat Florida". Both fall under the services part.

Even if it was only a promise, a promise is still has two elements: what occurs if the event happens and what occurs if the event does not occur.

When your defense plays aggressive, and I mean aggressive, with a few offensive players running around with some blood dripping from their nose and mouth offensively things start to slow down and certain plays in certain areas of the field are not called. In particular the QB and Skill players and to some extent the lineman. Can you remember Nebraska versus Tennessee. We quit due to their aggressiveness. They smacked us around at every position on the field. THAT HAS MOST CERTAINLY BEEN MISSING ON THIS TEAM IN GENERAL; does Shazzon Bradley and Dale Carter have any playing time left. WITH AGGRESSIVENESS COMES FEAR OF THE OTHER TEAM. Every BCS champion has something in common: Extremely aggressiveness.

You can still throw the rock 30-40 times a game and play smash mouth football!!!!!!!!!!!!!!!!!!!!!!

...and again. Without needlessly debating all of the other issues with your admittedly simplified thesis, surely you can admit that without a contract there can be no warranty?

I would like to see you lay out the offer/acceptance/and consideration that formed this viable contract that would require some sort of remedy to be imposed upon Mr. Couch.

Then, perhaps we can debate if you are even in the ballpark of your interpretation of a guarantee (do you mean warranty or promise, as you used examples of both?).

Dooleave will NOT beat Florida. Nor will he cover a 14 point spread. The Florida game will be a massacre this year.

Just remember, he (Wilcox) had to play the personnel you have. They were thin on depth, but better than the previous year. Dooley was building essentially from the ground up. With more experience and more depth in year 3 they should have a greater ability to do more plus the S & Conditioning that comes with it.

Rag on the OP all you want. I LOVE this post. Players saying this means that they're gaining confidence, which is something these guys need. I hope to hell they come through with us. I love this staff, even with Dooley on it and I think we can do something special in the future.

Oh, yeah. I met up with a second string gator player who has never done anything while at florida over at the local target.

He said "walmart sucks and who's mo couch?"
