why do you even call it a contract.

A MOU is not a contract

It simply includes the terms to write into the contract--that's all

Terms of MOU even said must be signed by others who did not sign.

Not according to the MOU used to hire Rick Barnes and Butch Jones. Both clearly say that it is "an enforceable agreement" until it was superceded by a written employment agreement. See first paragraph. If they used a similar MOU, I believe the key words are "when fully executed" in the first paragraph. Is a contract that is only signed by the AD and the coach "fully executed"? I believe that Tennessee will owe him something unless Schiano requested a release. Examples of MOU used in the past are below.

i say nothing from the MOU... however, he may pursue something due to defamation... put the gun down! im not saying he deserves it, or that he will win, just sayin... this admin would probably pay him something to just go away and not call foul.

But that might mean calling Sandusky to testify.

A quick look into the Barnes MOU shows it was "fully executed" be the AD, Chancellor, and Financial Officer
as well as signed by Barnes. At that time and only at that time did it become enforceable.

The Schiano MOU was signed only by Currie and Schiano. ( I think) The Chancellor and Financial officer still would have had to sign it in order for it to become binding.

It especially would not be binding if their names were included on the document for their signature and lines were left blank.

So, still nothing here...move on:hi:

It is not "fully executed" until ALL required signatures are in place.

See on Jones's MOU that THREE signatures were required.
1) The Vice Chancellor and Director of Athletics-Dave Hart
2) The Chancellor-Jimmy Cheek
3) The Chief Financial Officer-Scribildy Scrawl.

If any one of the signatures were not in place, the MOU is not "fully executed" and therefore unenforcable.
