Like it or not, she won't be anonymous once charges are brought. If AJ is arrested and goes through general sessions, she will take the stand at a preliminary hearing. If the DA direct presents to the Grand Jury, she still will likely take the stand on pretrail motions. Either way, if the case is prosecuted and AJ persists in his innocence there will be no way she will not take the stand in open court.

Thankfully, in the greatest country in the world, you have a right to confront and cross examine all witnesses offering proof against you. Also, her name will be on any indictment or affidavit charging AJ. There will be no anonymity if the case is pursued.

That is a very valid statement except for this...are you the one accused? The accused has the right to confront and cross examine the accuser; not a group of rabid football fans. None of us have the right to know any of the details concerning this or any other criminal case that doesn't directly involve us. I will agree, however, that all parties should remain anonymous during an investigation. I hope that AJ and Mike Williams are innocent, but that is not my "right" to decide.

I chose the name Pride85 because I was proud to be a member of the Pride of the Southland band in the 80's and I was very proud to be a VFL with blood still running bright orange. After reading many of the posts on the site this week, I am not so proud to be associated with a seemingly growing number of posters on this site.

Am I the only person here thats a bit disturbed, that the woman who accused Johnson of rape is essentially allowed to do so under total anonymity? While guilty or innocent she is already able to drag Johnson's name through the preverbal mud. I understand that law enforcement could be concerned about her safety, if her name was to be made public. However the same logic could still be applied to Johnson, since for all any of us know he could be guiltless in the matter, and now no matter the outcome his name has already been tarnished. Just does not seem like equal treatment by the law, regarding the accuser and the accused.

A another thing the other girl from Florida, pressed no charges and got the H@LL out of Knoxville fast, I know she had to get back to school, but you would think that Word RAPE being used, she would have stayed a day or 2 to make sure if true, there would be no cover up, makes you wonder don't it, and if this is a made up deal, both not one should go to JAIL, because AJ cant never get Saturday back, not just from a fans stand point, Senior Day, I don't care if he was a third teamer, you don't have senior day but once.:ermm:

Sorry but that's incorrect. Tennessee Rule of Evidence 412 is the Rape Sheild Rule. It basically protects the victim from confronting allegations about her reputation or unrelated prior sexual conduct, with exceptions. In the rape shield hearing, the victim herself can be called to testify. Plus, it's a rule of evidence which is promulgated by the Tenn Supremes. Legislature doesn't govern evidence rules.

Police reports are not available with public records requests until the case is closed.
Thanks for the clarification. The rule is referred to in the indices to TCA as the "rape shield law" which is a misnomer since the general assembly annually approves the rules of evidence by resolution not a bill.

I've been saying this since the first time I saw a "Just Busted" paper at the checkout line of a gas station. The law enforcement/judicial system has changed in the last 20 years, and not for the better.

if this was your daughter or mine,I would question her as to why she was out at 3am,at a mans apartment.yes to me that says she wanted sex,pure and simple.

And we all know that women are not allowed to desire sex. And if they do, they are certainly never allowed to change their minds about it!

Teams do this all the time. Suspended indefinitely for undisclosed reasons

If it was announced that AJ and Williams were suspended for "undisclosed reasons" right after a news story broke that 2 UT football players were accused or rape, it wouldn't be too hard to put 2 and 2 together.

THIS but I'd go so far as to say keep all names private until trial regardless of the accusation or charge. UNLESS the crime has key elements that would justify the public knowing prior to trial - political/official or police corruption, those deemed a threat to public safety due to past actions or crimes like murder/attempted murder where they may be still on the run, and those stories deemed to go beyond the mere crime page fodder and salaciousness. It would still be a judgement call to be sure and a code of ethics for the press to work out and follow but I'd love to see this type of change brought about.

I adimre the French for protecting the accused although there's is far too strict for my tastes and secrecy creates problems and makes the French system prone to corruption. BUT we could take a lesson here and tweak things to suit our needs - my suggestion would be it comes out at trial.

NOTE: The press could still describe pertinent details of the crime as well as describe the accused but a bit of protection BEFORE trial begins is warranted, imo. Especially, now that what happens in Podunk, USA follows you everywhere.

How about, you lied to the police? How about you discredited the mans name forever? HOw about if I called the police or fire department on some false pretenses, I would be locked up?

Start locking up the women who lie about rape and this will make them think twice about lying to police and giving a false statement.

At this point, a woman has nothing to lose by lying about it. No consequences at all

What is your definition of "scott free"? Unless the accuser has a record, a false report is rarely going to merit anything more than a fine and probation. The nature of the false report won't really change that.

Couldn't one say this about falsifying a report of any crime? Keep in mind, despite what some on here appear to believe, false reports of rape aren't all that common compared to other crimes.

The problem we are having in society today is that the criminal justice system is inconsistent and a lot of times unfair. The rich get the high profile lawyers and walk when evidence suggest otherwise. The same crime could be committed by someone poor and they would get time in prison. So now, in that environment, the PC crowd annihilates any high profile case in the public arena via text, Facebook, Twitter etc. This pressure forces something to be done immediately in terms of punishment without regard of evidence or proof outside the criminal justice system. The fair thing to do would have been to let both the ut players play until evidence from a valid investigation was completed. If this would have happened, everyone would have had a fair shake. If the girl was making it up, The two players lives would not have been effected other than the lesson of being careful not to get into those type situations in the future. If they did rape and assault the two girls, they would be locked up for several years and of course be terminated from UT. Unfortunately the NFL and other sports establishments are making rash decisions that could not be lawfully executed in other careers. If I was accused of something and was suspended from my job without having my day in court, then later found out to be innocent, I would and could sue the employer. These players will not be able to do that. It appears if this does turnout to be a made up crime, people will just go sorry our bad. Act like nothing happened, come back. IMO opinion that is a travesty of justice.

Anyone that has access to the PD report have access to her name. It's the newspaper, iirc, whose policy it is to not release potential sexual assault victims names.

Let's just assume for a second that the allegations are true.

Now, pretend this is your daughter. Something that she has been the victim of is out in the news like this with a high profile athlete at a university full of fans who don't care who your daughter is and are hell bent on trashing her name.

That is why her name is anonymous. Don't be so insensitive.

Ok AJ is your son. It turns out he's innocent. Some of you really need to get off your horse....

I don't believe accusations warrent suspensions but that's just me. I believe people are innocent until proven guilty. Not just for Vols but all Americans.

It's a tough situation. It will also be very unfortunate if after our bowl game, they are proven to be the victims of a set up by a scorned female. It was all a farce. It's ok now, AJ you can come back to the team...oh wait. Good luck with the rest of your life. Bye
 
That has never been said. I want them to be thrown under the jail if it's true. But I don't want players that are innocent to be treated as guilty until it is proven.

If it's proven, they were never innocent to begin with. If it's proven, you don't want it to be said that you allowed rapists to play for your team.

It's harsh, but it is what it is.
