Honestly, I'm not sure how it works in this circumstance. If the patient signs a HIPAA waiver, it's specific as to who receives the information.

My guess would be she had his release crafted and effectively told him what to say. You do not want to find yourself in the position of divulging HIPAA protected info no matter how benign. The civil penalties are severe.
