I think if your “delayed” it is 30 days. I may be wrong.

I double checked. If your state goes through NICS the federal .gov cannot (by law anyway) cannot keep the records more than 24 hours after the transaction is complete, denied or passed. If your state has it's own system records are kept/destroyed per state law. So it's not uniform around the country.

I got delayed last year or the year before. If I remember correctly the salesperson told me my name would be attached to that gun for 30 days or until my background check came back with denied or proceed. It may be a SC thing. Anyway I was delayed on Friday and they called back that Monday saying I was good to go.

Yeah its kept until the transaction is complete, denied or passed. SC is a full NICS state.

Yeah, but keep 4473s on file for life.

And if said dealer goes out of business? They get shipped to the ATF.

There were plenty of ways around the registry prohibition.

All true except for life, I think the 4473s are only kept for 20 years buy the FFL.

Still can't store the info electronically though, only microfiche so that's somewhat of a win if that's not being ignored.

I can see it now by the FBI, we destroyed the firearms data chief. Okay good, did you back it up first?

You are correct. Forgive me, it's the bound book that has to be kept for life.

Oh, well I can rest easier now. There is no electronic paper trail.

I can't remember because its been 2 years or so since I've bought a gun, but do they place the gun serial number on the paper work? If so, then would they be able to trace that gun back to the person that bought it? Do they go to the gun store to track down who made the purchase?
 

Just to add legally the seller can transfer the firearm to you after 3 business days if the background check hasn’t came back. I don’t know of any business that will actually do it though. Maybe some pawn shops but I guarantee none of the big box stores or major gun shops will.

Yes, the serial number is on the 4473.

When the police need to trace a gun they go to the manufacture who tells them what distributor it went to, the distributor tells them what retailer it went to, the retailer (if still in business) pulls the 4473 and tells them who purchased it. If the retailer is out of business they go to the microfiche in WVa. Past the initial buyer there is no way to trace it.

Yes they put the gun information on the paperwork. I assume they would be able to trace it back to the buyer if somehow that gun was used in a crime. When doing a person to person sale it’s best you retain that information when you make the transaction. It varies by state but in SC I can sell to another person as long as they can legally own a gun.

Unless your state requires you to keep the record of sale it is best NOT to.
