Grand Jury to hear Johnson / Williams case (Merged)

I don't dispute the findings. There wasn't enough evidence to charge. What was odd was that the DA decided to put the defense evidence before the grand jury.

As I said, I didn't follow it that closely.

I know that I don't trust much of the media to report information correctly. There is no incentive to do so. We the people would much rather have our feelers engaged than our thinkers. Therefore, news is reported in such a way that fact is twisted, or ignored, in a way to get to the feels over the reals.

In the book "The System: The Glory and Scandal of Big Time College Football" by J. Benedict and A. Keteyian (Doubleday 2013), multiple chapters are devoted to the discussion of sex crimes committed by athletes. In pertinent part there was a study done in the mid 1990s, the only study of its kind, at 30 Div. 1 colleges with top 20 football and basketball programs.

In all, 107 cases of sexual assault were examined. The primary finding was that male student-athletes made up just 3 percent of the male student population yet were responsible for more than 19 percent of the reported sexual assaults on campus.

This sounds eerily familiar:

But the lion's share of sexual assault cases against college football players...usually involve a victim who willingly goes to an athlete's turf--his dorm room, apartment, or hotel--and later claims that something happened she didn't sign up for. In almost every instance, the accused player admits to sexual contact and claims it was consensual. It sets up the classic he-said-she-said scenario with a unique twist--when athletes are involved it is usually she-said-they-said

Further:

Subsequent research has suggested a range of factors contributing to why some athletes are more prone to abuse women, from a sense of entitlement to a higher frequency of casual sex with multiple partners to a warped sense of women as sexual prey. But the biggest factor may boil down to opportunity or access

I have read some other studies, not surrounding athletes, that suggest that if you control for alcohol over consumption by one or both parties on college campuses, the rate of sex crimes drops sharply.

And check this out:

researches studied 217 criminal complaints of felony assault attributed to college and pro athletes between 1986 and 1995. The outcome in those cases was compared with national arrest and conviction rates for sexual assault. Two key findings emerged: 1. A criminal complaint against a college or pro athlete for sexual assault is far more likely to result in arrest and in an indictment. 2. Athletes are significantly less likely to be convicted

The author's offer some interpretation of this discrepancy:

The image of an athlete takes a hit before anything has been proven. The flip side is that these cases put police and prosecutors under a microscope too [the prosecutors generally face better defense attorneys in these cases than the general population would have, and] jurors are reluctant to convict athletes of sexual assault when the accuser has willingly gone to a player's bedroom or otherwise put herself in a compromising situation

In the case studied in the book, the defendant's were cleared against very damning evidence. The jurors were later questioned about why they had acquitted. The jurors responded that the athlete's "had suffered enough. They lost their scholarships, they were kicked off the team."

That's the power of college football...

ugh.

If you read that, and chapter 2 called "The Closer: The life of a college football hostess" that is all about Tennessee, you might rethink much of what you believe about college football.

When Sexual Assault or Rape Is Aggravated

Aggravated sexual assault or aggravated rape is a more serious form of the crime of rape or sexual assault, because the circumstances or the injury are considered “aggravated” or more serious than the circumstances or injury involved in other rapes or sexual assault. Some states have degrees of sexual assault or sexual penetration with first degree being the most serious form of the crime and the equivalent of aggravated sexual assault in other states.
The circumstances that distinguish aggravated sexual assault from non-aggravated vary from state to state. The following are commonly listed as circumstances that elevate the crime of sexual assault or attempted sexual assault to an aggravated offense:

  • the assailant uses, displays or threatens the victim with a deadly weapon during the offense
  • the offender causes serious or severe physical injury or permanently disfigures or disables the victim
  • the assailant acts with extreme indifference to human life during the commission of the assault
  • the offender attempts to kill the victim or another person during the commission of the assault
  • the assailant is aided by or commits the assault with one or more other person
  • the offender uses a rape drug to incapacitate the victim
  • the victim is physically helpless or temporarily or permanently unable to give consent because the victim is under the influence of alcohol or drugs, mentally incapacitated, elderly, or otherwise disabled or vulnerable
  • the assault involves incest or is committed by a step-parent or guardian
  • the offender has supervisory, disciplinary, or other power over the victim because of his legal, professional, or occupational status, and
  • the assault is committed during the commission or attempted commission of another felony such as kidnapping, robbery, homicide, aggravated assault, burglary, arson, or escape from jail or prison
If they are convicted they will probably never see the outside of a prison again.
 
If AJ did this he can rot for all I care. Aggravated Rape is one of the most depraved acts anyone can commit.

It needs to be pointed out over, and over, and over again that an indictment is not, nor is it anywhere near, a conviction.

These guys are innocent until PROVEN guilty.

I would have said this about Ted Bundy, or Charles Manson, or anyone else before they were convicted. I firmly believe in the philosophy behind it. We do a major disservice to ourselves to pass judgment too soon as we give the government the power that the grand jury system was intended to remove from them-the power to destroy people without a conviction.

Seems all of his showboating and sense of entitlement caused him to lose touch with reality. From future multi-millionaire to inmate. That's a very harsh reality.

I believe Drae did what he believed to be the right thing. And that's really all you can ask of him.

As for everything else. Only God, and the three (four maybe with the other girl that peaced out?) people involved know everything.
 
Don't know what to think.
Hell of a player but it doesn't excuse the actions if found guilty.
If they are innocent I feel terrible for them. The charge will follow them forever. If they are guilty throw their asses in River Bend and throw away the key.
 
I worked as a prison guard for a few years and convicted rapists are amoung the lowest on the food chain inside. Only Pedofiles and Dirty Cops carry more hatred
