I always figured that AJ had his phone with the text messages back and forth, when the accusations came he showed the texts, they preserved them, the prosecutors blocked the use of them, now the judge says they are fair game.

Just because she "lost" her phone and time has elapsed it doesn't mean the evidence is lost.

I wonder if there are pictures with a time stamp that prove "remorse rape".

If she was being provocative or complicit through messages, that's a lot different than agreeing to engage in sexual acts. So even if she was up for it before the party, yet once it started to happen and said "no" then that's rape.

Yes, and the sad thing is it is the Duke case all over again, he is innocent just like they were. There needs to be more done too a person that is proven to make a lying accusation against the other. Like going to jail for the crime you accused the person of, that would make people think before they made such a accusation. GBO!!!!

The reason why this case is taking a while is because the defense took the issue up by interlocutory appeal. So, it's the defense team that is litigating the issue, which causes a "delay."

As someone who does this line of work, there are some jurisdictions where it's very difficult to set a trial quickly because of the volume of cases. If your town is correct, I actually practice there, and it is a great example.

The Feds actually swear by the Speedy Trial Act, and you can try a case over there rather quickly. One issue, though, is that it is not easy preparing for a trial in a short amount of time, especially if it's a serious case. To be effective, a defense attorney has to allow for time to investigate, review evidence, and prepare. More time is usually better for the defense because things just happen.

Unfortunately for this guy, this ship has sailed and somewhat ruined the life journey he could have experienced as a professional football player.

The only good news here is charges were dropped and he didn't have to go through an even more public trial than that of the Social Media jury.
