He wasn't going to get a decent job this year anyway and I'm sure his agent would testify that they've made a reasonable effort. If this continues into 2019, UTAD needs to raise failure to mitigate.

I'm pretty sure it would be easy for a judge to believe Lyle screwed up his job search and being a window washing coffee getter was all he could do. His lawyer would just show the judge some of UT's games from last year.

The fact that Jones is a low-paid intern under Saban instead of a head coach or an OC at another university, is just more evidence that he was a bad hire... not that he's trying to screw the university out of money.

Yea, I'm in the camp that doesn't think the negativity that gets directed towards The University of Tennessee because of Butch is awesome.

Oregon St contacted Butch last year and he told them no. They might not have ended up hiring him, but Butch told them no the first time they contacted him and stopped pursuing.

Does telling another P5 school "no" when they contacted you about a head coaching position constitute a "good faith effort to secure comparable employment" or whatever the exact language says?

The guy they ended up hiring is making $1.9m/year. You gotta think if Butch got the job he'd be making at least that, because the guy they hired is pretty young and has no HC experience. That would have helped mitigate the buyout nicely.

When a school or business puts in a severance clause they do so knowing they're most likely going to pay it should the situation arise no matter the mitigating language included.

It's often not worth the legal or reputational expense to fight them.
